*Amend Intergovernmental Agreement with Metro for 82nd Ave planning and project development to increase amount to $920,000 and appropriate $420,000 in FY 2023-24 (amend Contract 30008082)
The City of Portland ordains:
Section 1. The Council finds:
- 82nd Avenue is a high priority for safety and maintenance investments as well as transit improvements. This grant from Metro will fund transit planning and early project development in partnership with PBOT’s funded safety and maintenance improvements for 82nd Avenue.
- In support of meeting the critical community need to improve transit on 82nd Avenue, Metro has agreed to increase the funds that may be paid by Metro to the City under the IGA from $500,000 to $920,000, and revise deliverables described in the Scope of Work
- The project number is T01342. The grant number is TR000331.
NOW, THEREFORE, The Council directs:
- The Commissioner-in-Charge is hereby authorized to accept on behalf of the City of Portland an amendment to a grant from Metro for 82nd Ave Planning and Project Development to increase the funds that may be paid by Metro to the City under the IGA from $500,000 to $920,000, and to revise deliverables described in the Scope of Work. Any increases to the Grant Amount must be approved by City Council.
- The Commissioner-in-charge to execute an amendment increasing Intergovernmental Agreement up to $920,000 in a form similar to attached Exhibit A.
- The Commissioner-in-Charge is authorized to execute amendments, approved as to form by the City Attorney, to the scope of the services or the terms and conditions of this Agreement, provided the changes do not increase the City’s financial risk.
- FY 2023-2024 budget is hereby amended as follows:

Bureau Program Expenses $420,000 - The OMF Grants Office is authorized to perform all administrative matters in relation to the grant application, grant agreement or amendments, requests for reimbursement from the grantor, and to submit required online grant documents on the Commissioner-in-Charge’s behalf.
Section 2. The Council declares that an emergency exists because delay would unnecessarily delay the City’s ability to perform the activities authorized in the IGA; therefore, this Ordinance shall be in full force and effect from the beginning of FY 2023-2024.

Purpose of proposed legislation and background information
- Metro has agreed to increase a grant originally in the amount of $500,000 of non-federal transportation funds to PBOT to $920,000 to pay for transit planning work on 82nd Avenue. The increased funding will be used exclusively for the shared consultant team currently under contract for planning and design work for 82nd Avenue.
Financial and budgetary impacts
- The 82nd Avenue Transit Project planning tasks will cost $920,000. This IGA will increase the original contribution from Metro for transit planning and project development from $500,000 to $920,000. This funding will be used to fund tasks in the existing consultant contract.
- The project number is T01342, and the grant number is TR000331. The project is budgeted in T01183.
- The budget changes resulting from this amendment are identified in the table below.
- No match is required for the additional portion of the grant.
- No work outside of the scope of this grant agreement is anticipated.

Community impacts and community involvement
- This IGA amendment allows the Portland Bureau of Transportation and Metro to continue the community planning and project development of the 82nd Avenue Transit Project. This IGA amendment includes funds for the planning phase, public meetings, workshops, and focus groups with communities connected to 82nd Avenue.
100% renewable goal
- This action decreases the City’s total energy use by supporting planning for improved transit on one of the highest ridership lines in the State of Oregon.
- This action allows the region to compete for Federal Transit Administration funds for improved transit on 82nd Avenue. If successful, the future transit project would include federally funded battery-electric transit vehicles which would increase use of renewable energy.
