Emergency Ordinance

*Amend Intergovernmental Agreement with Portland Public Schools for compliance and other services related to the Workforce Training and Hiring Program to extend term and increase compensation (amend Contract 3006338)

The City of Portland ordains: 

Section 1.  The Council finds:

  1. The City has a compelling governmental interest in facilitating the full participation of all persons in opportunities generated by the City’s public works contracts, as detailed in the previously adopted 2012 Social Equity Contracting Strategy by the City Council.
     
  2. The City entered into an Intergovernmental Agreement (IGA) with Portland Public Schools (PPS) on July 1, 2018 to provide project specific data collection and reporting services, for a training program substantially similar to the City’s Workforce Training and Hiring Program (WTHP) on certain PPS construction projects. The IGA was executed pursuant to authority under PCC 5.33.040. On August 2022, amendment 4 to the IGA extended the IGA for another one-year term and provided additional compensation.
     
  3. PPS has expressed an interest in continuing to utilize the City’s services to collect and report on workforce data on select PPS construction projects.
     
  4. The proposed amendment to IGA would permit the City to continue to provide training, assistance, and compliance services to PPS.  In return, PPS will coordinate this program with the City and provide funding to the City in the sum of $62,545.  This IGA will expire June 30, 2024.
     
  5. The City has the expertise to provide the service support to PPS and providing external services to PPS will not detriment or diminish the capacity, quality or quantity of the work and services that the City does for itself in this area.

NOW, THEREFORE, the Council directs:

  1. The Chief Procurement Officer (CPO) is authorized to execute an amendment to IGA No. 30006338 with PPS in a form substantially in accordance with the IGA attached hereto as Exhibit A, upon approval as to form by the City Attorney.
  2. The Chief Procurement Officer (CPO) is authorized to execute future amendments to the IGA for further extension of term and modifying scope of obligations, and upon approval as to form by the City Attorney; however, increases to fiscal or legal risks to the City shall be reviewed and approved by the Council.

Section 2.  The Council declares that an emergency exists to prevent disruption of compliance services related to the Workforce Training & Hiring Program; therefore, this Ordinance shall be in full force and in effect from and after its passage by the Council.

An ordinance when passed by the Council shall be signed by the Auditor. It shall be carefully filed and preserved in the custody of the Auditor (City Charter Chapter 2 Article 1 Section 2-122)

Purpose of Proposed Legislation and Background Information

Portland Public Schools has expressed an interest in continuing a Workforce Training and Hiring Program substantially similar to the training program adopted by the City.  The proposed 5th amendment to the IGA would permit the City to continue to provide compliance and other services related to administration of the program to Portland Public Schools.
