Emergency Ordinance

*Revise sewer and stormwater rates, charges and fees in accordance with the FY 2023-24 Sewer User Rate Study (amend Ordinance 191293 and amend ENB-4.20)

The City of Portland ordains:

Section 1.  The Council finds:

  1. Through an error, the System Development Charges presented on Exhibit A to Ordinance No. 191293 did not align with the Council’s intent.

  1. The proposed corrected sewer and stormwater rates, charges, and fees are consolidated into a comprehensive schedule as set forth in Exhibit A to this Ordinance.  The consolidated schedule does not preclude the establishment or continuation of charges and fees by resolution, ordinance, Code provision, or administrative rule not otherwise specified in this Ordinance.

NOW, THEREFORE, the Council directs:

  1. The Council adopts for Fiscal Year 2023-24 the sewer and stormwater rates, charges, and fees set forth in the attached Exhibit A.
  2. All other terms and provisions of Ordinance No. 191293 remain the same.
  3. This ordinance is binding City policy.

Section 2. The Council declares that an emergency exists to avoid charging rates higher than the Council-directed level; therefore, this Ordinance shall be in full force and effect from and after its passage by the Council.


An ordinance when passed by the Council shall be signed by the Auditor. It shall be carefully filed and preserved in the custody of the Auditor (City Charter Chapter 2 Article 1 Section 2-122)

Purpose of Proposed Legislation and Background Information

This annual ordinance establishes rates, charges and fees to generate sufficient revenue for projected expenditures in FY 2023-2024. The proposed ordinance will correct errors in Exhibit A to Ordinance No. 191293.
