Declare as surplus property a City-owned Cessna 172N and authorize the Chief of Police to proceed with a public sale of the property

The City of Portland ordains:

Section 1.  The Council finds:

  1. Portland Police Bureau’s (PPB) Cessna 172N (“Cessna”), a 1978 fixed wing, single engine airplane, serial number 17270654, was acquired by the City in 1999 for the bureau’s Air Support Unit. Its tail number is N739MR.
  2. On April 4, 2023, Commander Chris Gjovik identified this property as surplus equipment as the designee for the purposes of 5.36.010.D (see Exhibit A).
  3. Ordinance 191161, passed on February 1, 2023, authorized the purchase of a replacement aircraft for the Police Bureau.
  4. The Cessna, which is no longer capable of functioning as a law enforcement tool, has not been used to support PPB calls for service since 2022. As a surplus property, this airplane is currently a liability to PPB with costs for storage and maintenance of its basic airworthiness
  5. In accordance with Administrative Rule ARC-FIN-6.12, "Disposal of Capital Assets," PPB has contacted the City’s Office of Management and Finance and established that PPB has met the minimum standards for the disposal of capital assets under this administrative rule.
  6. PPB, through its Property Evidence Division, is working with the City’s contracted an external auction service, GovDeals, to ready the Cessna for public sale in accordance with Portland City Code Chapter 5.36.

NOW, THEREFORE, the Council directs:

  1. That the Cessna identified in subsection 1 is surplus property.
  2. That the Chief of Police, or the Chief’s designee, is authorized to sell the Cessna identified in subsection 1 by means of a public sale facilitated by the City’s external auction service, and is authorized to execute documents required for the sale and conveyance of title on behalf of the City.

An ordinance when passed by the Council shall be signed by the Auditor. It shall be carefully filed and preserved in the custody of the Auditor (City Charter Chapter 2 Article 1 Section 2-122)

Impact Statement

Purpose of Proposed Legislation and Background Information

The Portland Police Bureau (PPB) would like to dispose of one of its Cessna aircraft as surplus property.

In 1999, PPB purchased a 1978 Cessna 172N, serial number 17270654, Tail Number N739MR.

The airplane has been flown approximately 1235 hours and has completed 188 patrol support missions, assisting to respond to priority calls for service since its purchase.  This airplane’s equipment is no longer able to support law enforcement missions, and the aircraft has a high amount of flight hours on its frame.

In 2023, PPB was authorized by City Council to purchase a newer Cessna to replace this 172N.  Since that purchase, the Cessna 172N has not been in service.  It was deemed as surplus by the Commissioner-in-Charge’s designee, the Special Resources Division’s Commander Gjovik on April 3, 2023.

PPB, once authorized, will complete the auction of this aircraft with a City-approved vendor, GovDeals, in accordance with City Code 5.36.010, Disposition of Surplus Property.

Financial and Budgetary Impacts

Disposing of this asset will allow the City to save the costs of maintaining and storing an item not used in service to the City.

Community Impacts and Community Involvement

Removing this aircraft from PPB’s inventory will ensure that there is one less Cessna using leaded gasoline in Portland’s skies.

Financial and Budget Analysis

Disposing of this asset will allow the City to save the costs of maintaining and storing an item not currently used in service.  In addition, proceeds from the sale of the asset will go to Portland Police Bureau as the owner of the asset. The bureau should then transfer those funds into its Equipment Replacement Reserve Fund to help offset the purchase of a new plane.
