*Authorize Intergovernmental Agreement with Prosper Portland to transfer an employee for the Social Equity and Education Development Initiative Program

The City of Portland ordains:

Section 1. The Council finds:

  1. The City will have transferred certain grants that are part of the Social Equity & Education Development (“SEED”) Initiative Program to Prosper Portland, pursuant to an Assignment of Grant Agreements, dated Effective July 1, 2023.
  2. Prosper Portland agreed to assume the duties and obligations under these assigned grants pursuant to the Assignment of Grant Agreements, dated Effective July 1, 2023.
  3. The City has an employee who will be transferred to Prosper Portland as part of the transfer of the assigned SEED grants.
  4. ORS 236.610 requires the City and Prosper Portland to enter into an Agreement for the transfer of employee from the City to Prosper Portland.

NOW, THEREFORE, the Council directs:

  1. The Interim Director, Mourad Ratbi, is hereby authorized to execute an agreement substantially in the form attached as Exhibit A.

Section 2. The Council declares that an emergency exists because delay in proceeding with this agreement will unnecessarily deprive the City and Prosper Portland of the mutual benefits of this agreement; therefore, this Ordinance shall be in force and effect from and after its passage by the Council.

An ordinance when passed by the Council shall be signed by the Auditor. It shall be carefully filed and preserved in the custody of the Auditor (City Charter Chapter 2 Article 1 Section 2-122)

Purpose of Proposed Legislation and Background Information

The City will have transferred certain grants that are part of the Social Equity & Education Development (“SEED”) Initiative Program to Prosper Portland, pursuant to an Assignment of Grant Agreements, dated Effective July 1, 2023.  With the transfer, Prosper Portland agreed to assume the duties and obligations under these assigned grants pursuant to the Assignment of Grant Agreements, dated Effective July 1, 2023.

A City employee will be transferred to Prosper Portland as part of the transfer of the assigned SEED grants.  This IGA is necessary because ORS 236.610 requires the City and Prosper Portland to enter into an Agreement for the transfer of employee from the City to Prosper Portland.

Financial and Budgetary Impacts

The estimated value of sick leave and vacation leave to be transferred will be $12,850.

Financial and Budget Analysis

This ordinance transfers a City employee from the Office of Community & Civic Life to Prosper Portland as part of the transfer of SEED grants. Pursuant to ORS 236.610, this will require the City pay Prosper Portland a sum equal to the number of hours of accrued leave retained times the employee’s hourly rate, estimated to be $12,850 from the Cannabis Licensing Special Revenue Fund.
