Emergency Ordinance

*Amend contract with Portland Streetcar, Inc. to extend the agreement terms through June 30, 2025 and add $2,383,621 in compensation (Amend Contract 30004833)

The City of Portland ordains:

Section 1.  The Council finds:

  1. In 2015 the City of Portland solicited bids for Streetcar Operations Assistance through an open and competitive process and awarded a five-year contract to Portland Streetcar, Inc. (PSI), a 501c3 non-profit.
  1. Contract No 30004833 has been in effect since October 1, 2015, with original contract authority of $3,290,908.
  1. Contract No 30004833 allows for extensions of the agreement for an additional five-year period, to be taken individually or in multiple years.
  1. Contract was amended on March 15, 2018 by Amendment No. 1 to adjust work scope and financial considerations.
  1. Contract was amended on May 1, 2020 by Amendment No. 2 to extended term to June 30, 2021 and increase cost by $1,070,300 to not to exceed $4,361,208.
  1. Contract was amended on July 1, 2021 by Amendment No. 3 to extended term to June 30, 2023 and increase cost by $1,982,133 to not to exceed $6,343,341.
  1. Contract was amended on March 1, 2022 by Amendment No. 4 to modify terms.
  1. With this proposed Amendment No. 5, the contract term would be extended for two additional years to June 30, 2025 and the contract authority would increase to add compensation.
  1. To continue to provide a critical transit service, PBOT wishes to extend this contract with PSI to maintain important private sector and non-profit partnership engagement, and provide ridership customer service to deliver safe, stable public transit service connecting customers with housing, groceries, medical centers and jobs.
  1. The Bureau's level of confidence in the cost estimates for this project is high.

NOW, THEREFORE, the Council directs:

  1. That the Commissioner-in-Charge is hereby authorized to amend Contract No 30004833 with Portland Streetcar, Inc. to extend the terms of agreement attached as Exhibit A through June 30, 2025

Section 2. The Council declares that an emergency exists because the parties wish to continue work in a seamless manner in order to deliver safe, stable transit service to the public; therefore, this Ordinance shall be in full force and effect from and after its passage by the Council.

An ordinance when passed by the Council shall be signed by the Auditor. It shall be carefully filed and preserved in the custody of the Auditor (City Charter Chapter 2 Article 1 Section 2-122)

Purpose of Proposed Legislation and Background Information

  • Approval of this ordinance would extend the existing contract with Portland Streetcar, Inc. (PSI) to June 30, 2025. The original five-year contract has been in effect since October 1, 2015. A one-year extension was approved on September 16, 2020 with a two-year extension on July 1, 2023. Clauses in the contract allow for extensions of the agreement for up to an additional five years, to be taken individually or in multiple years.
     
  • This contract extension amendment would extend the contract term for two additional years to June 30, 2025 and the contract authority would increase to add compensation for the extension period.

Financial and Budgetary Impacts

Community Impacts and Community Involvement

  • There is not expected to be any opposition to this ordinance. This contract extension allows Portland Streetcar to continue operating safety and efficiently to provide a vital transportation option in the City of Portland.

100% Renewable Goal

This action is neutral in terms of the amount of energy used – the Streetcar system runs on 100% renewable electricity however this particular contract will not have any impact on the amount or quality of energy used. 

Maintaining streetcar operations and supporting continued growth in the system will increase the City’s use of renewable energy.  Streetcar runs on 100% renewable energy today and ongoing operations including the addition of new service will only grow the City’s share of renewable energy. 

Budget Office Financial Impact Analysis

This action extends by two years the existing contract with Portland Streetcar Inc. (PSI). The additional compensation to be paid is PSI totals $2,382,621. The FY2023-24 Proposed Budget includes $25.9 million in revenue for streetcar operations.
