Emergency Ordinance

*Accept grant for $597,000 from Oregon Department of Transportation and authorize Intergovernmental Agreement for the NE 42nd Ave Bridge Replacement: Bike Improvements at NE Lombard project

The City of Portland ordains:

Section 1.  The Council finds:

  1. The Portland Bureau of Transportation (PBOT) is replacing the NE 42nd Avenue bridge over NE Lombard Street. The project will also improve the flow and safety of bicycle and pedestrian traffic.  
     
  2. The Oregon Department of Transportation (ODOT) has requested that PBOT make certain improvements on NE Lombard Street in this location in conjunction with PBOT’s 42nd Avenue Bridge Replacement project.
     
  3. ODOT has notified the City of Portland (PBOT) that it will contribute to the amount of $597,000 for the NE 42nd Avenue Bridge Replacement project for certain improvements describe in the IGA attached.
     
  4. The project number for this is T00713. The grant number is TR000355.

NOW, THEREFORE, the Council directs:

  1. The Commissioner-in-Charge is hereby authorized to accept on behalf of the City of Portland a grant from the Oregon Department of Transportation for the NE 42nd Bridge Replacement project in the amount of $597,000.
  2. The Commissioner-in-charge to execute an Intergovernmental Agreement in the amount of $597,000 in a form similar to the contract attached as Exhibit A.
  3. The Commissioner-in-Charge is authorized to execute amendments, approved as to form by the City Attorney, to the scope of the services or the terms and conditions of this Agreement, provided the changes do not increase the total project cost by twenty percent (20%) or greater. 
  4. The OMF Grants Office is authorized to perform all administrative matters in relation to the grant application, grant agreement or amendments, requests for reimbursement from the grantor, and to submit required online grant documents on the Commissioner-in-Charge’s behalf.

Section 2.  The Council declares that an emergency exists because a delay would unnecessarily delay the City’s ability to perform the activities authorized by the grant; therefore, this Ordinance shall be in full force and effect from and after its passage by the Council.

An ordinance when passed by the Council shall be signed by the Auditor. It shall be carefully filed and preserved in the custody of the Auditor (City Charter Chapter 2 Article 1 Section 2-122)

Impact Statement

Purpose of Proposed Legislation and Background Information

PBOT will be replacing the 42nd Avenue Bridge and will be constructing a new bridge to current code. The bridge spans over the Lombard St (ODOT). The Oregon Department of Transportation (ODOT) has requested that PBOT make certain improvements on NE Lombard Street in this location in conjunction with PBOT’s 42nd Avenue Bridge Replacement project. This agreement will allow PBOT to charge ODOT for these services.

Financial and Budgetary Impacts

  • Costs for this project will be posted to PBOT Capital Project T00713, which is included in PBOT’s Adopted FY2022-23 budget and five-year CIP forecast.
     
  • The grant number for this will be TR000355.
     
  • PBOT has committed funding for design and construction of the project with several funding sources. GF: $6,024,084; SDC: $2,000,000; HVUT1: $2,000,000; HVUT2: $2,000,000; HB2017: $3,000,000; Developer: $60,000; and Build Portland: $3,000,000; for a total of $18,084,084.
     
  • ODOT will fund $597,000 to pay for the Lombard St improvements described in the attached IGA.

Community Impacts and Community Involvement

  • The project has started public involvement process during the current design. Design is currently at 95%.
     
  • PBOT has had several open houses throughout the design of the project and attend neighborhood meetings as well. We will be coordinating the project with serval stakeholders including Freight committee, Bicycle and Pedestrian committees and other agencies such as ODOT, UPRR, TriMet, etc.
