Emergency Ordinance

*Amend contract with Raimore Construction to increase amount for the Outer Division Multi-Modal Safety Project for a total of $10,282,592 (amend Contract 30007700)

The City of Portland ordains:

Section 1. The Council finds:

  1. In 2021, the City Council awarded a contract for the construction of the Outer Division Multi-Modal Safety Project to Raimore Construction in the amount of $7,530,290
  1. During construction, unforeseen field conditions related to the asphalt pavement  and upgrades to Bureau of Environmental Services stormwater management infrastructure, as well as necessary minor design modifications, have resulted in additional costs that are necessary to incur to successfully construct the safety improvements along the corridor and minimize future disruptions to the surrounding community and traveling public. 
  1. The Portland Bureau of Transportation proposes to increase the total construction contract with Raimore Construction to $10,282,592.

NOW, THEREFORE, the Council directs:

  1. The Director of the Portland Bureau of Transportation or designee is authorized to execute additions to Contract No. 30007700 with Raimore Construction for the purpose and amount described in Section 1, to increase the total contract amount to $10,282,592.
  2. The Portland Bureau of Transportation Director or designee is authorized to execute subsequent change orders to the contract, provided the cumulative total of all subsequent change orders does not exceed 10% of the new contract value of $10,282,592.

Section 2.  The Council declares that an emergency exists because the construction contract is active and the Portland Bureau of Transportation needs to remain on track with contract payments; therefore, this Ordinance shall be in full force and effect from and after its passage by the Council.

An ordinance when passed by the Council shall be signed by the Auditor. It shall be carefully filed and preserved in the custody of the Auditor (City Charter Chapter 2 Article 1 Section 2-122)

Impact Statement

Purpose of Proposed Legislation and Background Information

  • This ordinance increases the total value of the Outer Division Multi-Modal Safety Project with Raimore Construction to cover additional costs related to pavement reconstruction, signing and striping, traffic control and stormwater infrastructure.
     
  • The total amount of added work is $2,752,302.

Financial and Budgetary Impacts

  • The proposed amendment adds $2,752,302 in construction bid items to the existing construction contract, changing the contract amount from $7,530,290 to $10,282,592.
     
  • The ordinance allows a contingency of an additional 10% of the new contract amount for unforeseen subsequent change orders, to be approved by the PBOT Director or delegate. Project staff do not intend to use this provision but wish to have it included to avoid returning to Council for a small but compulsory additional change order.
     
  • Of the proposed contract amendment to add $2,752,302, an estimated $2,364,302 is for PBOT-related scope items and $388,000 is for BES-related scope items, pursuant to the project MOU between the Bureaus.
     
  • On February 3, 2022, after a presentation from project staff, PBOT’s internal Capital Investment Committee voted affirmatively to approve an additional $1.9M from eligible Bureau funding sources to cover the added paving scope on SE Division.
     
  • The remaining added contract costs will be covered within the existing project budget that is funded through a combination of General Fund, Fixing Our Streets, House Bill 2017, Transportation System Development Charges and Gas Tax Revenue.
     
  • The internal project number is T00629.

Community Impacts and Community Involvement

  • The increased contract amount will allow PBOT to pay its contractor for required design modifications for the Outer Division Multi-Modal Safety Project while also delivering important pavement and sewer infrastructure upgrades at the same time, resulting in greater community benefit and reduced impact to residents, business and property owners and the traveling public.
     
  • This change order will result in approximately $1,500,000 in additional contract work for firms designated as Disadvantaged, Minority or Woman-Owned Business Enterprises.

Budget Office Financial Impact Analysis

This ordinance increases the contract amount with Raimore Construction by $2,752,302 and includes allows contingency of 10% of the new total amount of $10,282,592 due to unforeseen field conditions and upgrades to BES stormwater infrastructure. The added amount with be covered within the existing project budged of $13,035,000.
