Amend contract with Universal Protection Service, LP dba Allied Universal Security Services to increase amount by $661,173 for additional Professional Security Officer Services (amend Contract 31002159)

The City of Portland ordains:

Section 1.  The Council finds:

  1. OMF Integrated Security Program is responsible for managing the daily security needs of City-owned buildings and locations that make up over one million square feet of office and retail space. These locations have a high level of public use Monday through Friday, and weekends at some locations, 365 days a year. Over 4,500 employees work at these locations daily. The City requires armed and unarmed security officer services, both plain clothed and uniformed, at several buildings and locations managed by the City. Security coverage needs range from static to dynamic and may be affected by the weather, programmed events, holidays, school schedules, and the level of security activity required.
  1. On January 30, 2019, City Council passed Ordinance No. 189365 authorizing the Chief Procurement Officer to conduct a competitive solicitation in accordance with City Code for Security Officers for an estimated amount of $10,000,000 over five years, on behalf of the Integrated Security Program. On February 11, 2019, Procurement Services issued Request for Proposals (RFP) No. 00001162 for Professional Security Officer Services. Responses were due on March 14, 2019 and four proposals were received. All four proposals were deemed responsive to the requirements of the solicitation. The proposals were evaluated and scored by a panel of evaluators including a community member participant from the Minority Evaluator Program.
  1. On March 29, 2019, in accordance with the solicitation requirements, the City issued a Notice of Intent to Negotiate and Award to the highest scoring proposer, G4S Secure Solutions, Inc. The notice was publicly posted for seven calendar days and no protests or other public comments were received during that period.
  1. G4S Secure Solutions, Inc. has a current Business Tax registration and meets the City's contracting compliance requirements. The Bureau's level of confidence in the not-to-exceed amount for the Price Agreement is "High" as there is good historical information regarding purchases made for these services, and annual wage increases in line with the City's Fair Wage Policy are included in the not-to-exceed amount of the agreement.
  1. A contract for Professional Security Officer Services in the amount of $10,000,000 was awarded to G4S Secure Solutions, Inc. to provide Professional Security Officer Services for the following City-owned buildings: The Portland Building, City Hall, 1900 Building, Columbia Boulevard Wastewater Treatment Plant (BES), Water Bureau at Interstate, Kerby Yard (PBOT), the 911 Bureau of Emergency Communication (PCC), and the Portland Bureau of Emergency Management (ECC).  The contract expiration date is June 30, 2024.
  1. Amendment no. 1, dated December 15, 2020, increased the contract amount by $593,003.84 to allow for Professional Security Officer Services for the Water Lab.
  1. Amendment no. 2, dated October 1, 2021, reassigned contract no. 31001574 with G4S Secure Solutions, Inc. to contract no. 31002159 with Universal Protection Service, LP dba Allied Universal Security Services.  
  1. Amendment no. 3, dated June 30, 2022, increased the contract amount by $4,297,809.44 to allow for Professional Security Officer Services at the Water Pollution Control Lab, Columbia Boulevard Wastewater Treatment Plant – Swan Island, and Delta Park. Amendment no. 3 removed Professional Security Officer Services at Union Station and the 400 Building.
  1. In accordance with Portland City Code 3.99, Fair Wage Policies, this contract for Professional Security Officer Services requires that impacted workers be compensated at the minimum hourly rate as determined by City Council. The minimum wage rate for all personnel employed in the performance of this Agreement is $17.82 per hour.
  1. This ordinance authorizes an additional $661,173.10 to allow for increased professional security officer services effective February 1, 2023.
  1. This ordinance authorizes Executive Protection services in the way of Executive Protection Agents. The Team will consist of three (3) armed agents (one acting as Team Leader) providing services throughout an approximate 40-hour business week including extended hours and weekends as needed. The Agents will be tasked with providing transportation, protection, and logistics support.
  1. The Office of Management and Finance recommends that contract no. 31002159 with Universal Protection Service, LP dba Allied Universal Security Services for Professional Security Officer Services be amended to increase amount by $661,173.10 for a new total contract value not to exceed $15,551,986.38.

NOW, THEREFORE, the Council directs:

  1. The Chief Procurement Officer is authorized to amend contract no. 31002159 with Universal Protection Service, LP dba Allied Universal Security Services to increase amount by $661,173.10 for a new total contract value not to exceed $15,551,986.38, provided the amendment is approved as to form by the City Attorney’s Office.
  1. The Mayor and the Auditor are hereby authorized to execute payments to Universal Protection Service, LP dba Allied Universal Security Services when demand is presented and approved by the proper authorities.

An ordinance when passed by the Council shall be signed by the Auditor. It shall be carefully filed and preserved in the custody of the Auditor (City Charter Chapter 2 Article 1 Section 2-122)

Purpose of Proposed Legislation and Background Information

This ordinance authorizes an additional $661,173.10 to allow for increased professional security officer services effective February 1, 2023.

This ordinance authorizes Executive Protection services in the way of Executive Protection Agents. The Team will consist of three (3) armed agents (one acting as Team Leader) providing services throughout an approximate 40-hour business week including extended hours and weekends as needed. The Agents will be tasked with providing transportation, protection, and logistics support.

Financial and Budgetary Impacts

This contract amendment will be funded by increase in the interagency agreement with Facilities Security as provider and the Mayor’s Office as receiver. The increase will be done in the Spring Budget Monitoring Process Report for February thru June costs and is being included in the FY 2023-24 interagency agreement.

Budget Office Financial Impact Analysis

This contract amendment will be funded by increase in the interagency agreement between OMF Integrated Security Program and the Mayor’s Office. The increase will be funded out of vacancy savings in the current year budget with a technical adjustment forthcoming in the FY 22-23 Spring Supplemental Budget. The increased interagency cost will be included in the FY 2023-24 Requested Budget with the Mayor's Office reallocating existing resources to absorb the cost.
