Amend Building Regulations Code and Heating and Ventilating Regulations Code to clarify fee provisions and adopt State of Oregon 2022 Editions of the Oregon Structural Specialty Code and the Oregon Mechanical Specialty Code (amend Code Chapters 24.10 and 27.01)

The City of Portland ordains:

Section 1.  The Council finds:

  1. The City serves as the local administrator for the State Building Codes, pursuant to ORS 455.148, including the Oregon Structural Specialty Code and the Oregon Mechanical Specialty Code. 
     
  2. The City Council has previously adopted these codes by reference in Portland City Code Titles 24 (Building Regulations) and Title 27 (Heating and Ventilating Regulations), respectively.
     
  3. The State updated the Oregon Structural Specialty Code and Oregon Mechanical Specialty Code in October 2022; consequently, the City must adopt the 2022 Editions of the Oregon Structural Specialty Code and the Oregon Mechanical Specialty Code. 
     
  4. Portland City Code Sections 24.10.100 to 24.10.102 cover the topic of fees, but the headings are confusing as currently written because Section 24.10.100, entitled “Fees” has no content, and Section 24.10.101, entitled “General” and Section 24.10.102, entitled, “Building Permit and Plan Check/Process Fee” belong under the general heading of “Fees.”
     
  5. To eliminate the confusion with these headings, Sections 24.10.101 and 24.10.102 need to be repealed and their content added to Section 24.10.100.

NOW, THEREFORE, the Council directs:  

  1. Portland City Code Chapters 24.10 and 27.01 are amended as set forth in Exhibit A.

An ordinance when passed by the Council shall be signed by the Auditor. It shall be carefully filed and preserved in the custody of the Auditor (City Charter Chapter 2 Article 1 Section 2-122)

Impact Statement

Purpose of Proposed Legislation and Background Information

The State of Oregon Building Codes Division enacted changes to the Oregon Structural Specialty Code (OSSC) and the Oregon Mechanical Specialty Code.  These new codes are based upon current editions of the International Building Code and the International Mechanical Code. 

ORS 455.040 requires that the State Building Code be uniform throughout the State of Oregon.  The City serves as the local administrator for the State Building Code and has adopted the State Structural and Mechanical Specialty Codes by reference in Portland City Code Titles 24 and 27.

To maintain consistency with the State Building Code, the City should revise the applicable sections of Titles 24 and 27 to reference the current versions of the Oregon Structural Specialty Code and the Oregon Mechanical Specialty Code.  The attached ordinance accomplishes the State requirements by adopting new versions of these codes.  The ordinance also amends Section 24.10 by combining the various sections related to fees under a single subsection to avoid confusion.

This ordinance amends references in Titles 24 and 27 to the current editions of the Oregon Structural Specialty Code and the Oregon Mechanical Specialty Code, along with the International Codes on which they are based.  It also combines various subsections in Section 24.10 related to fees to eliminate current confusion based on the various subsection headings.

The City of Portland, Bureau of Development Services serves as the local administrator for the State Building Codes.  The State of Oregon adopted the 2022 Oregon Structural Specialty Code and the Oregon Mechanical Specialty Code.  Consequently, the City must amend the local titles that reference these codes to reflect the current State adopted versions.

Financial and Budgetary Impacts

There are no financial or budgetary impacts associated with the proposed ordinance outside of standard costs associated with code changes, including purchasing new code books and staff training.  No new regulations are created by the proposed amendments.

Community Impacts and Community Involvement

No community involvement was conducted in the development of this ordinance. Limited outreach will be conducted to inform customers of the State code changes.
