Emergency Ordinance

*Amend contract with Bentley Systems, Inc. to increase the value by $648,000 for engineering design and drafting software and related support services through December 31, 2025 (amend Contract No. 30003001)

The City of Portland ordains:

Section 1.  The Council finds:

  1. In 2013, the City entered into Contract No. 30003001 with Bentley Systems, Inc. for engineering design and drafting software used to develop plans to construct infrastructure improvements. The contract supports essential citywide work to design and produce plans for construction of transportation, water and other infrastructure improvements throughout the City. 
     
  2. Contract No. 30003001 reached the end of its initial term in 2015.  Under the Chief Procurement Officer’s authority, further amendments were executed which extended the contract term to October 3, 2022 and increased the value of the contract value to  $1,220,000.
     
  3. This ordinance authorizes adding funding to Contract No. 30003001 in the amount of $648,000 for a new total not-to-exceed value of $1,868,000 to fund the subscription charges from October 3, 2022 to December 31, 2025  to support the City’s capital project delivery program. The amendment secures and locks the costs for the subscription fees and services through December 31, 2025.  
     
  4. Expenditures for this amendment shall be funded by existing budget appropriations, with no additional or new appropriates required, unless adjustments are part of the  normal budgetary change and adjustment process, including any required Council approvals. 

NOW, THEREFORE, the Council directs:

  1. The City's Chief Procurement Officer is hereby authorized to execute an Amendment to Contract No. 30003001 with Bentley Systems, Inc. to increase the not-to-exceed value of the Contract by $648,000 for a new total not-to-exceed value of $1,868,000 provided the Amendment is approved as to form by the Office of the City Attorney.

Section 2. The Council declares that an emergency exists as a delay in proceeding with executing this amendment may result in additional expenses and the inability to provide the required software services to develop designs and construction plans to construct capital infrastructure projects as programmed; therefore, this Ordinance shall be in full force and effect from and after its passage by the Council.

An ordinance when passed by the Council shall be signed by the Auditor. It shall be carefully filed and preserved in the custody of the Auditor (City Charter Chapter 2 Article 1 Section 2-122)

Purpose of Proposed Legislation and Background Information

The purpose of this ordinance is to authorize an amendment to contract number 30003001 with Bentley Systems, Inc.  The amendment will increase the value of the contract by $648,000 for a new not-to-exceed amount $1,868,000 and extends the term of the contract from October 3, 2022 to December 31, 2025.  This software is used to for computer aided design and drafting to develop plans to construct capital improvement projects throughout the City. This is the 7th contract amendment.   

Financial and Budgetary Impacts

Expenses associated with this agreement are estimated to be $648,000 apportioned over the October 3, 2022 to December 31, 2025 term. The Portland Bureau of Transportation (PBOT) and the Portland Water Bureau (PWB) are the primary users of this software.  Expenditures for this amendment shall be funded by existing budget appropriations, with no additional or new appropriations required, unless adjustments are part of the normal budgetary change and adjustment process, including any required Council approvals. 

Community Impacts and Community Involvement

This action will not have a material community impact and there was no community involvement in its development. However, this action does provide the engineering and drafting software PBOT needs to deliver programmed capital projects that enhance safety and provide transportation systems throughout the City.
