Emergency Ordinance

*Ratify a successor collective bargaining agreement between the City and Laborer's Local 483 relating to the terms and conditions of employment of Seasonal Maintenance Workers for 2022-2026

The City of Portland ordains:

Section 1. The Council finds:

  1. The City and Laborers' Local 483 (the Union) are parties to a collective bargaining agreement effective July 1, 2018, to June 30, 2022 (the 2018-2022 CBA).
  2. The Union is the sole and exclusive bargaining agent for the purpose of establishing wages, hours and conditions of employment for employees in the Seasonal Maintenance Worker (SMW) classification at the City.
  3. On March 2, 2022, pursuant to its obligations under ORS 243.650 et seq., the City entered into negotiations for a successor agreement to the 2018-2022 CBA with the Union.
  4. On January 14, 2022, representatives of the City and the Union signed a Tentative Agreement, Exhibit A (the Agreement) attached, hereto and incorporated by this reference, that outlines the terms and conditions of employment for bargaining unit members in the SMW classification for the period of July 1, 2022 through June 30, 2026 (the 2022-2026 successor CBA).
  5. As of this date this ordinance is submitted, the Union has ratified the Agreement.
  6. The Agreement meets the City's bargaining interests by securing a four-year collective bargaining agreement and agreeing to wage increases, health benefits, and other terms and conditions of employment.
  7. The Agreement continues to apply the principles of total compensation as the basis for bargaining all monetary subjects and ties general compensation to the Consumer Price Index (CPI). General wage increases will continue to be tied to the Portland CPI-W for West Size A.
  8. Upon ratification by City Council, salary rates for bargaining unit employees in the SMW classification are to be increased retroactively to July 1, 2022. Salary rates for 2022-2023, 2023-2024, 2024-2025, and 2025-2026 are to be increased by 100% of the annual increase in the Portland CPI-W. However in no event shall the salary increase for 2022-2023, 2023-2024, 2024-2025, and 2025-2026 be less than one percent or greater than five percent.
  9. Effective upon ratification, SMW bargaining unit members may work a maximum of 1,600 hours in a calendar year. This is an increase of 200 hours per year from the 2018-2022 CBA. The cost associated with this provision will not materially affect the current service level budgets for the impacted bureaus, as number of hours worked per calendar year could be limited by budgetary constraints and diverse City/bureau priorities.
  10. The Agreement continues the current health insurance premium share at 90 percent/ 10 percent for the first year of The Agreement. Effective July 1, 2023, the premium share will become 95/5 for the remainder of The Agreement.
  11. Effective upon ratification, the City has agreed to guarantee job interviews for up to five Seasonal Maintenance Workers when they apply for a position with the City represented by Local Laborers' 483.
  12. The terms and conditions of the 2022-2026 successor CBA shall conform substantially to a form similar to Exhibit A.
  13. The Mayor, the Chief Human Resources Officer, and the City Auditor shall be authorized to execute the 2022-2026 successor CBA with approval as to form by the assigned Deputy City Attorney.

NOW, THEREFORE, the Council directs:

  1. The Mayor, the Chief Human Resources Officer, and the City Auditor are authorized to execute the 2022-2026 successor CBA between the City and the Union relating to the terms and conditions of employment for employees in the SMW classification, with approval as to form by the assigned Deputy City Attorney.
  2. The 2022-2026 successor CBA shall conform to a form similar to the Agreement attached as Exhibit A.
  3. The City is authorized to pay for any City cost increases with the 2022-2026 successor CBA from the General Fund and other impacted funds, which includes the Gulf Fund, Transportation Operating Fund, Water Operating Fund and Portland International Raceway Fund.
  4. This ordinance is binding City policy.

Section 2. The Council declares that an emergency exists in order to avoid an unnecessary delay in the orderly implementation of the provisions of the 2022-2026 successor CBA; therefore, this Ordinance shall be in full force and effect from and after is passage by the Council.

An ordinance when passed by the Council shall be signed by the Auditor. It shall be carefully filed and preserved in the custody of the Auditor (City Charter Chapter 2 Article 1 Section 2-122)

Financial and Budgetary Impacts

SMW Fiscal Impact:

The total city-wide Year 1 (FY 2022-23) fiscal impact is estimated to be approximately $89,000. Of this amount, $61,000 represents the General Fund portion of this increase. The total fiscal impact for Year 2 (FY 2023-24) is estimated to be $241,000, with the General fund’s portion totaling $158,000. When fully implemented in Year 3 (FY 2024-25), the fiscal impact is estimated to be $398,000, with the General fund’s portion totaling $258,000. The total fiscal impact for Year 4 (FY 2025-26) is estimated to be $417,000, with the General fund’s portion totaling $270,000. The cumulative four-year total fiscal impact is estimated at $1,145,000, with the General Fund portion totaling $747,000.

Budget Office Financial Impact Analysis

The current year FY 2022-23 total cost impact of this CBA is $89,000. Outyear costs of this labor contract will be built into the bureau’s budget and be built into the General Fund ongoing appropriation targets at a rate of proportionate to the portion of their Fund 100 budget that is driven by personnel costs (currently 57%). The bureau projects that the remaining 43% will be absorbed by the Parks 2020 Local Option Levy resources (33%) and bureau external revenue (10%). The Bureau of Human Resources the total cost of this CBA to be $1.2M with a projected General Fund discretionary impact of $653,000.
