Authorize bid solicitation and contract with the lowest responsive and responsible bidder for construction of the North Schmeer Road East of Whitaker Road Project for an estimated cost of $1,386,000

The City of Portland ordains:

Section 1.  The Council finds:

  1. A developer improved a dedicated right-of-way (ROW) with new curb, sidewalk, and storm facilities on North Schmeer Road East of Whitaker Road.
     
  2. The existing water pipes, associated service lines, and fire hydrants in North Schmeer Road, owned by the Portland Water Bureau, must be moved due to the new ROW cross-section. The water main currently located underneath the sidewalk exhibits multiple conflicts with the new ROW development.  
     
  3. The existing water facilities must be replaced to ensure accessibility, operability, and water quality of the existing water system in the North Schmeer Road East of Whitaker Road Water Mains Project (Project) area.
     
  4. The Project will replace the existing water pipes, associated service lines, and fire hydrants to meet operation and flow conditions and construct the new facilities in accordance with all applicable codes and standards, including installing earthquake resistant pipe due to high liquefaction potential in the area.
     
  5. The Project has been planned and located in accordance with appropriate engineering standards for the construction, maintenance, and improvement of the City’s water infrastructure. The solicitation for the procurement action for the construction will use the City’s standard construction procurement bid process.
     
  6. The Portland Water Bureau engineer’s estimate for the contract action is $1,386,000. Funding for this Project, with budgeted contingency, is available in the FY 2022-23 Budget and is being reimbursed by the Developer.

NOW, THEREFORE, the Council directs:

  1. That City Procurement Office is authorized to bid the solicitation for construction of the Project.
     
  2. Upon the Council’s acceptance of the Chief Procurement Officer’s Report to Council recommending the lowest responsible bidder, the Chief Procurement Officer is authorized to negotiate and execute a contract, provided the contract has been approved as to form by the City Attorney’s Office.
     
  3. As required, a post-project evaluation of the Project will be provided to the Chief Procurement Officer to request and authorize final payment to the contract.
     
  4. The Mayor and City Auditor are hereby authorized to draw and deliver checks chargeable to the Water Fund when demand is presented and approved by the proper authorities.

An ordinance when passed by the Council shall be signed by the Auditor. It shall be carefully filed and preserved in the custody of the Auditor (City Charter Chapter 2 Article 1 Section 2-122)

Impact Statement

Purpose of Proposed Legislation and Background Information

The Portland Water Bureau is working hard to make your water system more resilient. This project is a small part of planned upgrades to keep your water safe.

The portion of North Schmeer Road East of Whitaker Road will soon see increased traffic and numerous new businesses. A developer improved a dedicated right-of-way (ROW) with new curb, sidewalk, and storm facilities on North Schmeer Road East of Whitaker Road. The existing bureau-owned water pipes, service lines, and fire hydrants in North Schmeer Road must be moved due to the changes in the ROW. The existing water facilities must be replaced to ensure accessibility, operability, and water quality in the North Schmeer Road East of Whitaker Road Project (Project) area. The new water facilities will better endure the increased demand from this area and will be more likely to withstand the effects of a large earthquake.

This Project will accomplish the following: 

  • install approximately 1,800 feet of new earthquake-resistant pipe made from ductile iron;
  • replace one 1-inch irrigation service;
  • replace one 4-inch residential service; 
  • replace one 8-inch fire service; and,
  • install six hydrants. 

Financial and Budgetary Impacts

The Portland Water Bureau determined the estimated cost to construct the Project based on past similar projects. The Project design is greater than 90% complete. The total construction procurement cost is estimated at $1,386,000. 

The total Project cost is estimated at approximately $1,703,000. The proposed water main extension was included as part of the development conditions on the Project and will be paid for by the developer. Funding is available in the FY 2022-23 Budget and will be requested in the FY 23-24 Budget. The confidence level is high for the Project and based on the guidelines detailed in the Project Estimate Confidence Level Rating Index. The proposed legislation will not create, eliminate, or re-classify any positions now or in the future.

Community Impacts and Community Involvement

The newly installed water mains and fixtures will serve businesses along North Schmeer Road. This Project will ensure public health and economic viability by improving the maintenance, operability, and water quality of the existing water system in the Project area. The new infrastructure will be earthquake resilient and will meet the increased demand from the area’s new and incoming businesses.  

Regarding construction impacts, the Project will be physically located in the right-of-way, generally in the main roadway along North Schmeer Road between North Whitaker Road and North Vancouver Avenue. The Portland Water Bureau will minimize impacts to local businesses and car, bike, and pedestrian traffic as much as possible. The Portland Water Bureau started notifying businesses and local travelers with mailers, signs, flyers, and social media posts over six months ago and will continue to do so through the Project’s duration. Contract documents about the Project limit how much street area may be affected at any given time. These limits will help decrease direct, daily neighborhood disruption and provide shorter detours for all traffic types around the active construction area.

There are no significant objections or concerns related to the Project. The Portland Water Bureau does not expect any groups to testify for or against the Project.

This legislation does not increase or decrease the City’s total energy use and does not increase or decrease the City’s renewable energy use.
