Emergency Ordinance

*Authorize contract with ConvergeOne, Inc. to provide Cisco network hardware, software, security support, and services in the amount of $11 million

The City of Portland ordains:

Section 1.  The Council finds:

  1. The Office of Management and Finance and the Bureau of Technology Services (BTS) is responsible for the operation and maintenance of the City’s network, Public Safety Radio transmissions and security systems including network and security hardware and software, which provides secure communication and connectivity for the entire City. 
  1. The network hardware and software support the backbone of the City’s communication infrastructure that enables City staff to have access to email, dial tone, the internet and other City applications, and supports radio traffic used by first responders and multiple regional public safety agencies. Security software helps to ensure safe and secure transmission of information.
  1. To maintain the City’s network and radio communications and monitor the security, both software and hardware upgrades and support must be performed regularly as new technology is introduced, and the systems must be expanded and scaled to meet increasing demand.
  1. In accordance with City Code 5.33.160, the City will establish a cooperative contract utilizing the State of Oregon Statewide Price Agreement Number 1605, which is the State of Oregon Department of Administrative Service’s Participating Addendum with the State of Utah’s Master Agreement AR3227 through the National Association of State Procurement Officers (NASPO) cooperative purchasing program.
  1. The estimated cost for the purchase of the network and security hardware and software support services over a period of five years is approximately $11,000,000.
  1. Implementing a 5-year agreement in lieu of continuing a year-to-year contract will save the City $1,274,958.43 on support costs over the life of the agreement.
  1. The Bureau’s confidence level in the estimated cost is medium.

NOW, THEREFORE, the Council directs:

  1. The Chief Procurement Officer is authorized to execute a contract with ConvergeOne, for network and security hardware and software support services for a term of five years and an amount not to exceed $11,000,000 provided such contract has been approved as to form by the City Attorney’s Office.

Section 2.  The Council declares that an emergency exists because a delay would interrupt the ongoing support of the networks; therefore, this Ordinance shall be in full force and effect from and after its passage by Council.

An ordinance when passed by the Council shall be signed by the Auditor. It shall be carefully filed and preserved in the custody of the Auditor (City Charter Chapter 2 Article 1 Section 2-122)

Purpose of Proposed Legislation and Background Information

The purpose of the proposed legislation is to execute a support contract with ConvergeOne, Inc. The agreement covers Smartnet hardware, software, and service support to the backbone of the City’s communication infrastructure that enables City staff to have access to email, dial tone, the internet and other City applications, and supports radio traffic used by first responders and multiple regional public safety agencies. Security software helps to ensure safe and secure transmission of information.

Financial and Budgetary Impacts

This ordinance authorizes a contract with ConvergeOne for a term of five years and an amount not to exceed $11,000,000. BTS has appropriation in their FY 2022-23 budget to cover the anticipated current year expense associated with this action. Funding for the out years of this agreement is included in the BTS 5-year and CIP plans.
