Emergency Ordinance

*Accept grant in the amount of $227,196 from the Oregon Department of Transportation and authorize Intergovernmental Agreement for the Traffic Signal Improvements on SE Holgate Blvd & 92nd Ave Project

The City of Portland ordains:

Section 1.  The Council finds:

  1. The Portland Bureau of Transportation (PBOT) applied to the Oregon Department of Transportation (ODOT) for a grant in the amount of $227,196 for Traffic Signal Improvements on SE Holgate Blvd & 92nd Ave in September of 2019; and
     
  2. ODOT has notified the City of Portland that it will award a grant for Traffic Signal Improvements on SE Holgate Blvd & 92nd Ave in the amount of $227,196; and
     
  3. This project was selected as part of the Surface Transportation Block Grant Program-Urban (STBG-U) and may include a combination of federal, state, and local funds; and
     
  4. The Traffic Signal Improvements on SE Holgate Blvd & 92nd Ave Project (T01182 grant TR000348 KN22530) includes installation of traffic signal controller communication improvements at up to seven (7) signal locations on SE Holgate Blvd and 92nd Ave; and
     
  5. The Oregon Department of Transportation (ODOT) has determined that the City of Portland is eligible for state and federal funds for the work to be performed under the attached agreement (Exhibit A). The Parties enter into the attached Agreement to exchange these funds, identify the Project that will be funded with the state and federal funds, and describe the method State will use to reimburse Agency for work performed on the Project using the state and federal funds, including establishing invoicing requirements and the proportional reimbursement rate; and
     
  6. Federal funds for this project total and are limited to $227,196.

NOW, THEREFORE, the Council directs:

  1. The Commissioner-in-Charge is hereby authorized to accept on behalf of the City of Portland a grant from the Oregon Department of Transportation for Traffic Signal Improvements on SE Holgate Blvd & 92nd Ave in the amount of $227,196.
     
  2. The Commissioner-in-charge to execute Intergovernmental Agreement in the amount of $227,196 in a form similar to the contract attached as Exhibit A.
     
  3. The Commissioner-in-Charge is authorized to execute amendments, approved as to form by the City Attorney, to the scope of the services or the terms and conditions of this Agreement, provided the changes do not increase the City’s financial risk by 20% or greater.
     
  4. The OMF Grants Office is authorized to perform all administrative matters in relation to the grant application, grant agreement or amendments, requests for reimbursement from the grantor, and to submit required online grant documents on the Commissioner-in-Charge’s behalf.

Section 2.  The Council declares that an emergency exists because a delay would unnecessarily delay the City’s ability to perform the activities authorized by the grant; therefore, this Ordinance shall be in full force and effect from and after its passage by the Council.

An ordinance when passed by the Council shall be signed by the Auditor. It shall be carefully filed and preserved in the custody of the Auditor (City Charter Chapter 2 Article 1 Section 2-122)

Purpose of Proposed Legislation and Background Information

  • Accept a grant from ODOT in the amount of $227,196 to fund a Surface Transportation Block Grant Program-Urban (STBG-U) Project for Traffic Signal Improvements on SE Holgate Blvd & 92nd Ave.
     
  • The Traffic Signal Improvements on SE Holgate Blvd & 92nd Ave Project (KN22530/T01182) includes installation of traffic signal controller communication improvements at up to seven (7) signal locations on SE Holgate Blvd and 92nd Ave. The location of the Project is shown on the sketch map attached hereto, marked “Exhibit A” of Exhibit A.

Financial and Budgetary Impacts

  • The proposed project will cost $253,200 (low confidence estimate). The project will be funded through an STBG-U grant from ODOT ($227,196) and a 10.27 percent local match from PBOT ($26,004), accounted for in the Build Portland funds as project number T01182.
     
  • Project T01182 is for Holgate Blvd. and 92nd Ave traffic signal improvement. The grant number for this project will be TR000348.
     
  • ODOT and PBOT agree to PBOT delivering Traffic Signal Improvements on SE Holgate Blvd & 92nd Ave.
     
  • Project costs were determined through engineers estimates in the application process, and PBOT received an STBG-U grant covering 89.73 percent of the estimated project costs.
  • The cost of the project has been accounted for in the Build Portland funding and PBOT’s FY 2022-23 CIP budget.
  • There is no work outside of the scope of the project anticipated, and no additional funds requested.

Community Impacts and Community Involvement

  • This action is administrative, and the execution of this contract is noncontroversial and will not have community impacts upon its execution.
     
  • Equity and creating safe streets for all Portland residents was taken into consideration when selecting projects for Transportation System Management and Operations (TSMO) improvements.
