The City of Portland ordains:

Section 1.  The Council finds:

  1. OMF Facilities Services Division is responsible for managing the daily security needs of City-owned buildings and locations that make up over one million square feet of office and retail space. These locations have a high level of public use Monday through Friday, and weekends at some locations, 365 days a year. Over 4,500 employees work at these locations daily. The City requires armed and unarmed security officer services, both plain clothed and uniformed, at several buildings and locations managed by the City. Security coverage needs range from static to dynamic and may be affected by the weather, programmed events, holidays, school schedules, and the level of security activity required.
  1. On January 30, 2019, City Council passed Ordinance No. 189365 authorizing the Chief Procurement Officer to conduct a competitive solicitation in accordance with City Code for Security Officers for an estimated amount of $10,000,000 over five years, on behalf of Facilities Services. On February 11, 2019, Procurement Services issued Request for Proposals (RFP) No. 00001162 for Professional Security Officer Services. Responses were due on March 14, 2019 and four proposals were received. All four proposals were deemed responsive to the requirements of the solicitation. The proposals were evaluated and scored by a panel of evaluators including a community member participant from the Minority Evaluator Program.
  1. On March 29, 2019, in accordance with the solicitation requirements, the City issued a Notice of Intent to Negotiate and Award to the highest scoring proposer, G4S Secure Solutions, Inc. The notice was publicly posted for seven calendar days and no protests or other public comments were received during that period.
  1. G4S Secure Solutions, Inc. has a current Business Tax registration and meets the City's contracting compliance requirements. The Bureau's level of confidence in the not-to-exceed amount for the Price Agreement is "High" as there is good historical information regarding purchases made for these services, and annual wage increases in line with the City's Fair Wage Policy are included in the not-to-exceed amount of the agreement.
  1. A contract for Professional Security Officer Services in the amount of $10,000,000 was awarded to G4S Secure Solutions, Inc. to provide Professional Security Officer Services for the following City-owned buildings: The Portland Building, City Hall, 1900 Building, Columbia Boulevard Wastewater Treatment Plant (BES), Water Bureau at Interstate, Kerby Yard (PBOT), the Bureau of Emergency Communication (911), and the Emergency Coordination Center (ECC).  The contract expiration date is June 30, 2024.
  1. Amendment no. 1, dated December 15, 2020, increased the contract amount by $593,003.84 to allow for Professional Security Officer Services for the Water Pollution Control Lab.
  1. Amendment no. 2, dated October 1, 2021, reassigned contract no. 31001574 with G4S Secure Solutions, Inc. to contract no. 31002159 with Universal Protection Service, LP dba Allied Universal Security Services.  
  1. In accordance with Portland City Code 3.99, Fair Wage Policies, this contract for Professional Security Officer Services requires that impacted workers be compensated at the minimum hourly rate as determined by City Council. The minimum wage rate for all personnel employed in the performance of this Agreement shall be $17.82 per hour.
  1. This ordinance authorizes an additional $4,297,809.44 to allow for rate increases effective July 1, 2022 and increased professional security officer services.
  1. This ordinance authorizes Professional Security Officer Services to begin for the following facilities effective July 1, 2022:
    1. Water Pollution Control Lab
    2. Columbia Boulevard Wastewater Treatment Plant – Swan Island
    3. Delta Park
  1. The following facilities are removed from the contract effective July 1, 2022:
    1. Union Station
    2. 400 Building
  1. The Office of Management and Finance recommends that contract no. 31002159 with Universal Protection Service, LP dba Allied Universal Security Services for Professional Security Officer Services be amended substantially in conformance with Attachment no. 1 to increase amount by $4,297,809.44 for a new total contract value not to exceed $14,890,813.28.

NOW, THEREFORE, the Council directs:

  1. The Chief Procurement Officer is authorized to amend contract no. 31002159 with Universal Protection Service, LP dba Allied Universal Security Services substantially in conformance with Attachment 1 attached to increase amount by $4,297,809.44 for a new total contract value not to exceed $14,890,813.28.
     
  2. The Mayor and Auditor are hereby authorized to execute payments to Universal Protection Service, LP dba Allied Universal Security Services when demand is presented and approved by the proper authorities.

Section 2.  The Council declares that an emergency exists because it is in the public interest that the contract is executed forthwith; therefore, this Ordinance shall be in full force and effect from and after its passage by Council.

An ordinance when passed by the Council shall be signed by the Auditor. It shall be carefully filed and preserved in the custody of the Auditor (City Charter Chapter 2 Article 1 Section 2-122)

Purpose of Proposed Legislation and Background Information

The purpose of this ordinance is to amend the contract with Universal Protection Service, LP dba Allied Universal Security Services to increase contract amount by $4,297,809.44 to provide additional Professional Security Officer Services.  These services are for many City buildings that OMF and other bureaus own, and for elected officials.  Most of the services are ongoing, but there are also allowances for services on an as needed basis.

Financial and Budgetary Impacts

This ordinance is funded thru IA rental rates charged to tenants of OMF owned facilities and thru IA billings charged to bureaus for services requested.

The bureau's level of confidence in the not-to-exceed amount for the price agreement is "High" as there is good historical information regarding purchases made for these services, and annual wage increases in line with the City's Fair Wage Policy are included in the not-to-exceed amount of the agreement.
