Emergency Ordinance

*Amend Contract with Lones Management Consulting, LLC to increase the not to exceed amount to $1,500,000 for Behavioral Health Emergency Coordination Network (amend Contract No. 30007795)

The City of Portland ordains:

Section 1.  The Council finds:

  1. The Office of Management and Finance’s Community Safety Division (CSD) was created to more effectively streamline safety and emergency services provided to the Portland community;
  2. The CSD Director has been tasked with facilitating the creation of the Behavioral Health Emergency Coordination Network (BHECN). The vision for BHECN is to provide a 24/7 single point of access for help for people experiencing a mental health or substance abuse crisis and requires consideration of the goals of law enforcement and the goals of the behavioral health system;
  3. Lones Management Consulting, LLC (Lones) is the consultant assisting with development of this Network.  The BHECN will be transitioned to Multnomah County for management after this phase of the project is completed;
  4. CSD has determined that the cost for the remaining work anticipated for this project will exceed the available amount of the Contract with Lones, and that it will need to add funds to complete the project;
  5. The increase in funds to the Contract will exceed the procurement authority of the Chief Procurement Officer to amend Professional, Technical and Expert (PTE) contracts with values up to $1,250,000 per City Code 5.68.035;
  6. CSD has sufficient funding within its FY 2022-23 budget appropriations to accommodate this amendment; and
  7. It is beneficial to the City and community that this Contract my be amended as quickly as possible to avoid a lapse in the program.

NOW, THEREFORE, the Council directs:

  1. That the Chief Procurement Officer is authorized to amend an agreement between the City and Lones Management Consulting, LLC as outlined in a form similar to the amendment attached as Exhibit A.
  2. The Bureau Director and the Project Manager are authorized to execute amendments to the scope of services or the terms and conditions of the Agreement, provided the changes do not increase the amount of compensation or increase the City's financial risk.

Section 2. The Council declares an emergency exists because a delay in executing the amendment may deprive the City of the benefits of the continuity of the CSD's efforts; therefore, this ordinance shall be in full force and effect from and after its passage by the Council.

An ordinance when passed by the Council shall be signed by the Auditor. It shall be carefully filed and preserved in the custody of the Auditor (City Charter Chapter 2 Article 1 Section 2-122)

Impact Statement

Purpose of Proposed Legislation and Background Information

The City of Portland has provided some form of outreach and sobering program since as early as 1971.  In 1982, a nonprofit organization assumed management of the City's sobering program and fulfilled that roll until 2020, when the complexity of sobriety issues, coupled with the impacts of the COVID pandemic, forced the program's closure.

The City took this opportunity to reimagine how it could assist individuals dealing with issues of addiction, and tasked a team with constructing the Behavioral Health Emergency Coordination Network (BHECN).

The vision for BHECN is to provide a 24/7 single point of access for help for people experiencing a mental health or substance abuse crisis and requires consideration of the goals of law enforcement and the goals of the behavioral health system.

The BHECN is close to being transitioned to allow Multnomah County to assume management of the Network and provide future enhancement; this amendment will allow the City to wind down its portion of the project in preparation for the hand-off.

Financial and Budgetary Impacts

There are sufficient funds in the Community Safety Division's appropriations to support this amendment.

Community Impacts and Community Involvement

Many community members are impacted by sobriety and substance-abuse issues.  The BHECN is being created in order to bring resources to bear in a centralized fashion, in order to provide the safest and most compassionate assistance the City of Portland can offer.
