Amend Cooperative Utility Agreement with the Oregon Department of Transportation for the US 26 Powell Blvd: SE 122nd Ave - SE 136th Ave Project in the amount of $372,951 (amend Contract No. 30006627)

The City of Portland ordains:

Section 1.  The Council finds: 

  1. Oregon Department of Transportation completed construction of the US 26 Powell Blvd: SE 122nd Ave. – SE 136th Ave. Project (Project). The Portland Water Bureau has potable water infrastructure services in the construction area that was impacted by this Project.
     
  2. The Portland Water Bureau entered into a Cooperative Utility Agreement with Oregon Department of Transportation, through Ordinance No. 189135, that established scopes of work and responsibility for payment.
     
  3. The estimated Portland Water Bureau cost of the work in the Cooperative Utility Agreement was $845,443.18. The final cost of the work was $1,218,395.15. The amendment to the Cooperative Utility Agreement will authorize an additional $372,951.97.
     
  4. Funding has been allocated in the FY 2021-22 Water Bureau Budget.

NOW, THEREFORE, the Council directs:

  1. That the Portland Water Bureau Director is authorized to execute on behalf of the City an amendment to the Cooperative Utility Agreement with the Oregon Department of Transportation in a form substantially in accordance with the amendment attached as Exhibit A and subject to approval as to form by the City Attorney.
     
  2. Upon receiving approval of this legislation and upon receipt of a fully executed copy of an amendment, the Portland Water Bureau is authorized to reimburse the Oregon Department of Transportation $372,951.97 for their work on this Project.
     
  3. The Mayor and Auditor are hereby authorized to draw and deliver checks chargeable to the Water Fund when demand is presented and approved by the proper authorities.

An ordinance when passed by the Council shall be signed by the Auditor. It shall be carefully filed and preserved in the custody of the Auditor (City Charter Chapter 2 Article 1 Section 2-122)

Impact Statement

Purpose of Proposed Legislation and Background Information

The Oregon Department of Transportation completed construction of the US 26 Powell Blvd: SE 122nd Ave – SE 136th Ave Project (Project). This Project required water infrastructure to be removed, relocated, or constructed. In November 2018, the Portland Water Bureau entered into a Cooperative Utility Agreement with Oregon Department of Transportation that established scopes of work and responsibility for payment.

The estimated Portland Water Bureau cost of the work in the Cooperative Utility Agreement was $845,443.18. The final cost of the work was $1,218,395.15. The amendment to the Cooperative Utility Agreement will authorize an additional $372,951.97.  

Financial and Budgetary Impacts

The Project is complete and the final cost to construct the Project improvements has been established based on actual construction costs.

The Portland Water Bureau currently maintains the water system within the Project limits.  Adjustments of the water infrastructure included in this Project will not change the long-term financial obligations of the City. The proposed legislation will not create, eliminate, or re-classify any positions now or in the future.

Community Impacts and Community Involvement

The Oregon Department of Transportation led the public involvement effort and performed outreach to affected residents and businesses. This Project supports City equity goals by improving access to services to low-income and under-served residents and businesses along Powell Blvd and improving pedestrian, cyclist, and traffic safety in a high-traffic corridor.

This legislation does not increase or decrease the City’s total energy use and does not increase or decrease the City’s renewable energy use.
