*Authorize a Letter of Agreement between the City and the Professional and Technical Employees Union Local 17 relating to the wages, hours, and working conditions of the Capital Project Manager II classification

The City of Portland ordains:

Section 1. The Council finds:

  1. The City and Professional and Technical Employees Local 17 are parties to a collective bargaining agreement (CBA) effective July 1, 2017, to December 31, 2021.
  2. The parties have been in negotiations for a successor contract and reached a Tentative Agreement on May 24, 2022. 
  3. In 2018, the City created the non-represented classification of Capital Project Manager II, ordinance 189157. With the existing salary grade 57 which currently has a range of $31.15 to $53.48 hourly / $66,872 to $111,238 annual full time.
  4. On October 12, 2021, the Oregon Employment Relations Board (ERB) certified PROTEC17 as the exclusive bargaining representative of employees in the Capital Project Manager II classification in the City of Portland.
  5. In May 2022 representatives of the City and PROTEC17 signed a Letter of Agreement, Exhibit A, that outlines the terms and conditions of adding the classification of Capital Project Manager II to the Schedule A of the successor City and PROTECT17 Labor Agreement.
  6. Exhibit A outlines the terms and conditions of adding the classification of Capital Project Manager II to the Schedule A of the current labor agreement. Employees covered under this agreement shall be eligible for the management leave rollover, ordinance 190577. Thereafter, employees in this classification shall not be eligible for management leave. All wage changes, including moving employee wages from grade to step shall be effective July 1, 2022.
  7. All other terms and conditions of the City and CBA shall apply to the Capital Project Manager II classification as stated in Exhibit A. 

NOW, THEREFORE, the Council directs:

  1. The Director of the Bureau of Human Resources is authorized to enter into a Letter of Agreement, Exhibit A, between the City and PROTEC17 for the Capital Project Manager II classification.
  2. This ordinance is binding City policy.

Section 2.  The Council declares that an emergency exists because delay would unnecessarily delay the orderly implementation of the provisions of this Letter of Agreement; therefore, this Ordinance shall be in full force and effect after its passage by the Council.


An ordinance when passed by the Council shall be signed by the Auditor. It shall be carefully filed and preserved in the custody of the Auditor (City Charter Chapter 2 Article 1 Section 2-122)

Impact Statement

Purpose of proposed legislation and background information

The purpose of this agreement is to amend schedule A to include Capital Project Manager II classification. The City and Union have an interest incentivizing the retention of Capital Project Manager II and this LAO creates the wages and benefits that shall apply to them.

Financial and budgetary impacts

The fiscal impact of applying the new wage scale for the Capital Project Manager II is estimated below over a four year period, bureaus shall manage this cost within existing current service level appropriation.

The total annual citywide fiscal impact of the new wage scale for the Capital Project Manager II is estimated to cost an additional $16,905 in 2022, $42,411 in 2023, $60,462 in 2024 and $71,741 in 2025. Bureaus with staff in this classification who are impacted by the change are the Housing Bureau, PBOT, BES, and OMF-Facilities Services. Bureaus will be expected to manage this cost within their existing resources.
