Emergency Ordinance

*Amend Intergovernmental Agreement with Metro to provide more travel options, increase use of active transportation options, and decrease vehicle miles traveled through Regional Travel Options programming (amend Contract No. 30007060)

The City of Portland ordains:

Section 1. The Council finds:

  1. On July 25, 2019, by Ordinance No. 189672, City council authorized execution of an Intergovernmental Agreement (IGA) with Metro to award the Portland Bureau of Transportation $945,000 to fund the Portland Bureau of Transportation’s Smart Trips, Connected Communities program.
  1. On April 5, 2021, The Portland Bureau of Transportation signed Amendment No. 1 which included an updated scope agreement with Metro.
  1. On October 27, 2021, Metro, the grant administrator formally notified project managers that the three-year grant will be extended for an additional fourth year due to the pandemic. The additional year allows for continued work on existing transportation demand management projects and/or changes to programming in response to the pandemic and includes additional funding.
  1. This second amendment is made to extend the term of contract No. 30007060 through June 30, 2023, adds additional scope, and includes additional funds. Metro will provide an additional federal FTA grant funding for fiscal year 2022-2023 of $308,996.00 for the Regional Travel Options Core Partner Grant. The Portland Bureau of Transportation will contribute an additional non-federal local match of $35,367.00.
  1. The grant order number is TR02940001.  The grant number is TR000294.

NOW, THEREFORE, the Council directs:

  1. That the Commissioner-in-Charge is hereby authorized to execute Amendment No. 2 to the Intergovernmental Agreement with Metro for programming and financial updates, in a form similar to the contract attached as Exhibit A.
     
  2. The Commissioner-in-Charge is authorized to execute amendments, approved as to form by the City Attorney, to the scope of the services or the terms and conditions of this Agreement, provided the changes do not increase the City's financial risk.
     
  3. The OMF Grants Office is authorized to perform all administrative matters in relation to the grant application, grant agreement or amendments, requests for reimbursement from the grantor, and to submit required online grant documents on the Commissioner-in-Charge’s behalf.

Section 2. The Council declares that an emergency exists because a delay would unnecessarily delay the City’s ability to perform the activities authorized by the grant; therefore, this Ordinance shall be in full force and effect from and after its passage by the Council.

An ordinance when passed by the Council shall be signed by the Auditor. It shall be carefully filed and preserved in the custody of the Auditor (City Charter Chapter 2 Article 1 Section 2-122)

Purpose of Proposed Legislation and Background Information

Financial and Budgetary Impacts

  • The total cost of the Smart Trips, Connected Communities program is $1,347.371.00 for programming during FY 2019-2023.
     
  • An additional fourth year of programming for the SmartTrips, Connected Communities program for FY 2022-23 includes a total program budget of $344,363.00. Metro will provide $308,996.00 for the program and PBOT will provide a local non-federal match of $35,367.00.
     
  • The internal order number is TR0294001.  The grant number is TR000294.
     
  • A match is required. The additional fourth year of the project requires an additional $35,367.00 in local non-federal match. This brings the total local match up to $138,376.00 for the four-year period. This local match is provided by GTR funds and is budgeted in the Requested FY 2022-23 budget.
     
  • No additional funds are requested as part of this ordinance.

Community Impacts and Community Involvement

  • A greater swath of our Portland community will be served through the extension of this grant. The SmartTrips New Movers program will operate every month of the year and become evergreen.
     
  • Subrecipients of this grant will also have continued support for the travel options programming. Subrecipients include: OPAL, Oregon Walks, PCRI, and Community Cycling Center.

Budget Office Financial Impact Analysis

The total cost of the Smart Trips, Connected Communities program is $1,392,372 for programming during FY 2019-2023. An additional fourth year of programming for the program for FY 2022-23 includes a total program budget of $344,363. Metro will provide $308,996 for the program, and PBOT will provide a required, local non-federal match of $35,367, bringing the total local match up to $138,376 for the four-year period. This local match is provided by General Transportation Revenue funds and is included in the FY 2022-23 budget. Additionally, Metro will provide the Sunday Parkways program with $45,000 in Sponsorship. This $45,000 is not subject to local match requirements.
