Emergency Ordinance

*Accept a grant in the amount of $90,321 from Oregon Department of Transportation, authorize Intergovernmental Agreement to install guardrail and reflective delineators and improve curve signage on SE Mount Scott Blvd between 101st Ave and 104th Ave, and appropriate $33,000 in FY 2021-22 (Amend Ordinance No. 190656)

The City of Portland ordains:

Section 1.  The Council finds:

  1. The Portland Bureau of Transportation (PBOT) applied to The Oregon Department of Transportation (ODOT) for a grant in the amount of $90,321 for SE Mount Scott Boulevard between 101st Avenue and 104th Avenue on 5/7/2018; and
     
  2. ODOT has notified the City of Portland that it will award a grant for SE Mount Scott Boulevard between 101st Avenue and 104th Avenue to PBOT in the amount of $90,321;
     
  3. The City of Portland wishes to exchange unspent federal funds for state funds, in order to fund installing guardrail and reflective delineators and improving curve signage on SE Mount Scott Boulevard between 101st Avenue and 104th Avenue using state funding. The Oregon Department of Transportation (ODOT) has determined that the City of Portland is eligible for state funds for the work to be performed under the attached agreement (exhibits A) through the State Funded Local Project (SFLP) Program. The Parties enter into the attached Agreements to exchange these funds, identify the Projects that will be funded with the state funds, and describe the method State will use to reimburse Agency for work performed on the Projects using the state funds, including establishing invoicing requirements and the proportional reimbursement rate; and
     
  4. The SFLP State funds for these for this project totals and are limited to $90,321.

NOW, THEREFORE, the Council directs:

  1. Ordinance No. 190656 is amended according to the following directives:
     
  2. The Commissioner-in-Charge is hereby authorized to accept on behalf of the City of Portland a grant from the Oregon Department of Transportation for SE Mount Scott Boulevard between 101st Avenue and 104th Avenue in the amount of $90,321.  Any increases to the Grant Amount must be approved by the City Council.
     
  3. The Commissioner-in-charge to execute an Intergovernmental Agreement in the amount of $90,321 in a form similar to the contract attached as Exhibit A.
     
  4. The Commissioner-in-Charge is authorized to execute amendments, approved as to form by the City Attorney, to the scope of the services or the terms and conditions of this Agreement, provided the changes do not increase the City’s financial risk.
     
  5. The FY 2021/2022 Budget is hereby amended as follows:

  6. The OMF Grants Office is authorized to perform all administrative matters in relation to the grant application, grant agreement or amendments, requests for reimbursement from the grantor, and to submit required online grant documents on the Commissioner-in-Charge’s behalf.

Section 2.  The Council declares that an emergency exists because a delay would unnecessarily delay the City’s ability to perform the activities authorized by the grant; therefore, this Ordinance shall be in full force and effect from and after its passage by the Council.

An ordinance when passed by the Council shall be signed by the Auditor. It shall be carefully filed and preserved in the custody of the Auditor (City Charter Chapter 2 Article 1 Section 2-122)

Purpose of Proposed Legislation and Background Information

  • Accept grant from ODOT in the amount of $90,321.19 to fund a SFLP Project at SE Mount Scott Boulevard between 101st Avenue and 104th Avenue.
     
  • ODOT and PBOT agree to PBOT installing guardrail and reflective delineators and improving curve signage at SE Mount Scott Boulevard between 101st Avenue and 104th Avenue to improve safety. The location of the Project is shown on the sketch map attached hereto, marked “Exhibit A.”

Financial and Budgetary Impacts

  • The proposed project will cost $97,941.00 (low confidence estimate). The project will be funded through an SFLP grant from ODOT ($90,321) and a 7.78 percent local match from PBOT ($7,620). The local match will be funded with GTR., as project number T01204.
     
  • The internal tracking project number is T01204, and the grant number is TR000329.
  • Project costs were determined through engineers estimates in the application process, and PBOT received a SFLP grant covering 92.22 percent of the estimated project costs.
     
  • There is no work outside of the scope of the project anticipated.
  • The FY 2021-22 budget is hereby amended as follows:

  • This action is administrative, and the execution of this contract is noncontroversial and will not have community impacts upon its execution.
