Emergency Ordinance

*Amend Joint Office of Homeless Services Intergovernmental Agreement with Multnomah County to extend the term of agreement (amend Contract No. 30005335)

The City of Portland ordains:

Section 1.  The Council finds:

  1. The County and PHB (“the Parties) entered into that certain Intergovernmental Agreement for the Joint Office of Homeless Services dated July 1, 2016 (the “Original Joint Office IGA”).
  1. The Original Joint Office IGA was amended by that certain First Amendment to Joint Office of Homeless Services dated April 18, 2017 (the “First Amendment”), and that certain Second Amendment to Joint Office of Homeless Services dated June 21, 2017 (the “Second Amendment”), and that certain Third Amendment to Joint Office of Homeless Services dated November 8, 2017 (the “Third Amendment”), and that certain Fourth Amendment to Joint Office of Homeless Services dated August 28, 2018 (the “Fourth Amendment”), and that certain Fifth Amendment to Joint Office of Homeless Services effective July 1, 2019 (the “Fifth Amendment”), and that certain Sixth Amendment to Joint Office of Homeless Services effective October 1, 2019 (the “Sixth Amendment”), and that certain Seventh Amendment to Joint Office of Homeless Services dated April 20, 2020 (the “Seventh Amendment”), and that certain Eighth Amendment to Joint Office of Homeless Services dated July 1, 2020 (the “Eighth Amendment”), and that certain Ninth Amendment to Joint Office of Homeless Services dated November 1, 2020 (the “Ninth Amendment”), and that certain Tenth Amendment to Joint Office of Homeless Services dated March 1, 2021 (the “Tenth Amendment”), and that certain Eleventh Amendment to Joint Office of Homeless Services dated August 18, 2021 (the “Eleventh Amendment”), and that certain Twelfth Amendment to Joint Office of Homeless Services dated December 15, 2021 (the “Twelfth Amendment”). The Original Joint Office IGA as amended by the First Amendment, Second Amendment, Third Amendment, Fourth Amendment, Fifth Amendment, Sixth Amendment, Seventh Amendment, Eighth Amendment, Ninth Amendment, Tenth Amendment, Eleventh Amendment, and Twelfth Amendment is referred to herein as the “Joint Office IGA”.
  1. Residents within both jurisdictions expect accountability and oversight regarding the investments in the Joint Office of Homeless Services (“Joint Office”). The changes set forth in this Thirteenth Amendment along with continued engagement in ongoing efforts to update and finalize new public-facing data dashboards and impact measures will support accountability and oversight.
  1. The Parties require more time to conclude negotiations on a new intergovernmental agreement for the Joint Office and desire to amend the Joint Office IGA to extend the term of the agreement.

NOW, THEREFORE, the Council directs:

  1. The Commissioner in Charge of PHB is hereby authorized to execute the Thirteenth Amendment of the Joint Office IGA, substantially in accordance with “Exhibit A”.

Section 2.  The Council declares that an emergency exists because a delay in passage of the Ordinance would cause a lapse in services provided by the Joint Office of Houseless Services; therefore, this Ordinance shall be in full force and effect from and after its passage.

An ordinance when passed by the Council shall be signed by the Auditor. It shall be carefully filed and preserved in the custody of the Auditor (City Charter Chapter 2 Article 1 Section 2-122)

Impact Statement

Budget Office Financial Impact Analysis

The IGA extension does not include any changes to budgeted appropriations or make new ongoing commitments. This amendment also replaces the Policy & Budget Alignment Committee with a new Executive Leadership group to communicate about policy and funding decisions, including mid-year adjustments. Additionally, primary responsibility for the HMIS system will transition from the Portland Housing Bureau to the Joint Office.
