Emergency Ordinance

*Accept grant in the amount of $2,623,000 from the Oregon Department of Transportation and authorize Intergovernmental Agreement for the NE Martin Luther King Jr Blvd Safety & Access to Transit Project

The City of Portland ordains:

Section 1.  The Council finds:

  1. The Portland Bureau of Transportation (PBOT) applied to the Oregon Department of Transportation (ODOT) for a grant in the amount of $2,623,000 for the NE MLK Blvd Safety & Access to Transit Project on 6/21/2019; and
  2. ODOT has notified the City of Portland that it will award a grant for the NE MLK Blvd Safety & Access to Transit Project to PBOT in the amount of $2,623,000;
  3. The project number is T00999.  The grant number is TR000333.

NOW, THEREFORE, the Council directs:

  1. The Commissioner-in-Charge is hereby authorized to accept on behalf of the City of Portland a grant from ODOT for the NE MLK Blvd Safety & Access to Transit Project in the amount of $2,623,000. 
     
  2. The Commissioner-in-charge to execute an Intergovernmental Agreement in the amount of $2,623,000 in a form similar to the contract attached as Exhibit A.
     
  3. The Commissioner-in-Charge is authorized to execute amendments, approved as to form by the City Attorney, to the scope of the services or the terms and conditions of this Agreement, provided the changes do not increase the total project cost by twenty percent (20%) or greater. 
     
  4. The OMF Grants Office is authorized to perform all administrative matters in relation to the grant application, grant agreement or amendments, requests for reimbursement from the grantor, and to submit required online grant documents on the Commissioner-in-Charge’s behalf.
     

 Section 2.  The Council declares that an emergency exists because a delay would unnecessarily delay the City’s ability to perform the activities authorized by the grant; therefore, this Ordinance shall be in full force and effect from and after its passage by the Council.

An ordinance when passed by the Council shall be signed by the Auditor. It shall be carefully filed and preserved in the custody of the Auditor (City Charter Chapter 2 Article 1 Section 2-122)

Budget Office Financial Impact Analysis

The purpose of this legislation is to accept a federal grant for design and construction of the NE MLK Blvd Safety & Access to Transit Project. The project invests in high-priority pedestrian safety and accessibility improvements along the corridor. PBOT applied to the Oregon Department of Transportation (ODOT) for a grant in the amount of $2,623,000 and will be awarded the grant for the project.  The project has been included in PBOT’s FY 2022-23 Requested Budget for PBOT’s capital improvement program. Total project cost is $4,723,000 with a low confidence estimate. A local match requirement of $2,100,000 is needed for the project, and is expected to be covered with Transportation System Development Charges (TSDCs) and General Transportation Revenue (GTR) funds.
