Emergency Ordinance

*Amend contract with Passport Labs, Inc. to increase the not-to-exceed value for procurement, licensing, and maintenance of a hosted Mobile Parking Payment System in the amount of $4,521,642 for a total amount of $6,661,816 (amend Contract No. 30005152)

The City of Portland ordains:

Section 1.  The Council finds:

  1. The City of Portland, Bureau of Transportation (City) operates paid on-street parking in the City of Portland, Oregon, that uses Parking Kitty as a hosted Mobile Parking Payment System, in addition to the multi-space pay stations.
     
  2. On November 21, 2016, as authorized by City Ordinance No. 187260, contract #30005152 was signed with Passport Parking, Inc. for the procurement, licensing, and maintenance of a hosted Mobile Parking Payment System (MPPS) for a five year not to exceed amount of $1,515,174.
     
  3. On February 25, 2019, the Chief Procurement Officer Authorized Amendment One to Contract #30005152 to increase the contract by $375,000 for a new not to exceed amount to $1,890,174, to extend the expiration date to November 20, 2026, and to change the name of Passport Parking, Inc. to Passport Labs, Inc.
     
  4. On August 30, 2019, the Chief Procurement Officer authorized Amendment Two to increase the not to exceed value by $250,000 to $2,140,174, and to add services for Portland Parks and Recreations for a Citation Management solution and Digital Permit product.
     
  5. The City has a need to increase the not to exceed amount of contract #30005152 for continuing operations of the hosted MPPS (Parking Kitty) as mobile payment solution for Portland Bureau of Transportation on-street metered space, SmartPark garages, and Portland Parks and Recreations parking lots.
     
  6. The Bureau's level of confidence in the cost estimates for this project is moderate.

NOW, THEREFORE, the Council directs:

  1. That the Chief Procurement Office is hereby authorized  to execute an amendment to Contract No. 30005152 with Passport Labs, Inc. in a form similar to the contract amendment attached as Exhibit A and subject to approval as to form by the City Attorney’s Office.
     
  2. The Mayor and City Auditor are hereby authorized to draw and deliver checks payable to Passport Labs, Inc., chargeable to the Parking Operations Division, the Parking Facilities Fund, and Portland Parks and Recreation
     

Section 2. The Council declares that an emergency exists because a delay would unnecessarily interrupt the City’s ability to provide mobile parking payment; therefore, this Ordinance shall be in full force and effect from and after its passage by the Council.

An ordinance when passed by the Council shall be signed by the Auditor. It shall be carefully filed and preserved in the custody of the Auditor (City Charter Chapter 2 Article 1 Section 2-122)

Impact Statement

Budget Office Financial Impact Analysis

This ordinance seeks to add additional funds to the City’s contract with Passport Labs, Inc. allowing for continued operations. The operating costs for Parking Kitty paid to Passport Labs, Inc. are paid by the customer and each transaction is collected by PBOT. Costs for this amendment will be posted to PBOT Parking Operations and the Parking Facilities Fund. Any adjustments to the budget are anticipated to take place in the Spring BMP or the Over-Expenditure Ordinance based on timing of implementation.
