Emergency Ordinance

*Amend contract with Kaiser Foundation Health Plan of the Northwest to add $168 million for total amount not to exceed $210 million (amend Contract No. 30006927)

The City of Portland ordains: 

Section 1.  The Council Finds: 

  1. In 2019 the Office of Management and Finance, Bureau of Human Resources filed an ordinance to authorize five contracts for the City’s self-insured and insured plan offerings, including Kaiser Foundation Health Plan of the Northwest, Vision Service Plan Insurance Company, Moda Health Plan, Inc., Oregon Dental Service dba Delta Dental Plan of Oregon, and Standard Insurance Company. 

  2. Council subsequently approved Ordinance 189607, authorizing all five contracts, each with a five year term effective July 1, 2019 through June 30, 2024. 

  3. Ordinance 189607 authorized funding through the contractual term for the following contracts: Vision Service Plan Insurance Company, Moda Health Plan, Inc., Oregon Dental Service dba Delta Dental Plan of Oregon, and Standard Insurance Company. 

  4. Ordinance 189607 authorized one year of funding for Contract No. 30006927 with Kaiser Foundation Health Plan of the Northwest.  The amount of compensation required over the period of the contract was incorrectly listed as $42,000,000 instead of the correct amount of $210,000,000.   

  5. The amount of $168,000,000 is needed to cover the remaining four years on Contract No. 30006927 with Kaiser Foundation Health Plan of the Northwest.  

NOW, THEREFORE, the Council directs: 

  1. The City’s Chief Procurement Officer is authorized to execute an amendment substantially similar in form to the draft amendment attached to the Ordinance as Exhibit 1(b), Sample City of Portland Amendment No. 1 to Contract No. 30006927, which adds $168,000,000 to Contract No. 30006927 for a new total not to exceed amount of $210,000,000, provided the Amendment has been approved as to form by the City Attorney’s Office. 

  2. The Mayor and the Auditor are hereby authorized to pay for the contract from BHR Health Fund Budget.  

Section 2. The Council declares that an emergency exists to delay in executing the administration of the Kaiser Health Plan; therefore, this Ordinance shall be in full force and effect from and after its passage by Council. 

An ordinance when passed by the Council shall be signed by the Auditor. It shall be carefully filed and preserved in the custody of the Auditor (City Charter Chapter 2 Article 1 Section 2-122)
