Amend Sewer User Charges Code to support updates to system development charges (amend Code Chapter 17.36)

The City of Portland ordains:

Section 1.      The Council finds:

  1. The Bureau of Environmental Services (BES) manages Portland’s wastewater and stormwater infrastructure to protect public health and the environment. 
  2. BES is granted the authority in City Charter to charge system development and connection charges “For all purposes relating to design, construction, acquisition, operation, maintenance and contract requirements of sewage treatment or purification facilities and related facilities…” (Portland City Charter Chapter 11-302).
  3. BES regularly reviews its Portland City Code (PCC) Chapters to identify changes needed to update language, correct cross-references, and improve clarity.
  4. PCC Chapter 17.36 should be updated to align language for residential developments with upcoming city-wide changes. City council authorized code changes to implement the Residential Infill Project (RIP) (ordinance number 190093) and Shelter to Housing Continuum (S2HC) (ordinance numbers 190380 and 190381), which will go into effect on August 1, 2021. These changes alter development types and zoning allowances for residential development.
  5. Language is added to address congregate housing facilities, which is a newly defined residential development type established in Title 33. This addition is made in Subsections 17.36.020.E and 17.36.040.C.2.a.
  6. The terms single-family and multi-family are used to describe residential developments and are now replaced with the terms single-dwelling and multi-dwelling development. This change better aligns with zoning code and places emphasis on the structure and use rather than the inhabitants.
  7. References to plumbing fixture unit are replaced with the term drainage fixture unit to conform to changes in the Oregon Plumbing Specialty Code.
  8. Provisions in code are updated to better align with adopted rules.
  9. This Ordinance will not require additional funds for implementation.

NOW, THEREFORE, the Council directs:

  1. That PCC Chapter 17.36, Sewer User Charges, is amended as shown in the attached Exhibit A.


An ordinance when passed by the Council shall be signed by the Auditor. It shall be carefully filed and preserved in the custody of the Auditor (City Charter Chapter 2 Article 1 Section 2-122)
