Authorize a five-year joint development agreement with Pierce Manufacturing Inc. for a reduced carbon emissions fire apparatus not to exceed $837,875

The City of Portland ordains:

Section 1.  The Council finds:

  1. The City’s 2015 Climate Action Plan pursues the reduction of local carbon emissions 80 percent from 1990 levels by 2050, with an interim goal of 40 percent by 2030 (Resolution 37135).
  2. Council directed City bureaus to implement policies and programs to keep Portland on a path to reduce local carbon emissions (Resolution 37136).
  3. In December 2016 Portland’s City Council voted unanimously to adopt the City’s 2017 Electric Vehicle Strategy directing bureaus to implement the actions identified in the strategy (Resolution 37255).
  4. The Mayor’s 2020-21 General Fund Budget Guidance listed Leadership Action on Climate Change as a priority, directing bureaus to prioritize actions to reduce carbon emissions that put the City on a trajectory to achieve a 50 percent reduction in carbon emissions by 2030 and to present budgets that lead to a meaningful reduction of carbon pollution.
  5. Portland Fire & Rescue seeks Council’s authorization to test and assess a reduced carbon emissions fire apparatus for a not-to-exceed amount of $837,875 by adoption of this ordinance. This cost includes $690,000 for the fire apparatus and $147,875 for the purchase and installation of a charging system at a fire station.
  6. Through a joint development agreement, PF&R will operate a reduced carbon emissions apparatus for five years at Station 1.
  7. Reduced carbon emissions fire apparatus technology is new and evolving; entering into a joint development agreement will allow PF&R to assess the new technology and provide input on the development of future fire apparatus.
  8. PF&R’s apparatus replacement budget and reserve will fund this five-year demonstration; research for potential grant funding opportunities are underway.
  1. The Bureau’s confidence level in this project and estimated cost is high.

NOW, THEREFORE, the Council directs:

  1. The Chief Procurement Officer is authorized to enter into a Joint Development Agreement with Pierce Manufacturing Inc., on behalf of the City for the purposes identified in Section 1, provided the Agreement has been approved as to form by the City Attorney’s Office.
  2. The Portland Fire & Rescue Chief is authorized to execute amendments to the agreement, including amendments that obligate additional City funds if the appropriations are approved by City Council and approved as to form by the City Attorney’s Office.

An ordinance when passed by the Council shall be signed by the Auditor. It shall be carefully filed and preserved in the custody of the Auditor (City Charter Chapter 2 Article 1 Section 2-122)
