Amend Fair Wage Policies Code to reflect current minimum wage rate index (amend Code Section 3.99.020)

The City of Portland ordains:

Section 1. The Council finds:

  1. Chapter 3.99 of the Portland City Code regulates the City’s Fair Wage Policies.
     
  2. On May 13, 2015, City Council amended Portland City Code section 3.99.020, establishing the minimum wage for positions at the City of Portland and contracts for covered services shall be $15.00 an hour. This section also includes the method The Office of Management and Finance applies to establish a yearly minimum wage.
     
  3. This section of code is out-of-date. The Portland-Salem OR WA CPI-W is no longer published and is not available for the City Economist to calculate the yearly minimum wage.

NOW, THEREFORE, the Council directs:
 

  1. City Code Section 3.99.020 Adjustments is amended as set forth below:

Thefiscal year 2015-16 State and Federal law sets the base minimum wage. Unless otherwise directed by Council,minimum wage shall be no less than $15 per hour. The Office of Management and Finance shall provide City bureaus with a yearly minimum hourly wage rate for covered services which is anticipated to be adjusted annually by the change in the consumer price index identified for use by the City of Portland and Portland-Salem OR WA CPI -W as provided by the City Economist or pursuant to the terms of a City collective bargaining agreement for such represented employees if it differs from the City Economist.  The adjustment shall be effective for all contracts on July 1 of each year.  In determining the adjustment amount, the Office of Management and Finance shall take into account the City’s overall financial picture, and OMF shall not interpret this Code to require any increase which is inconsistent with the City’s financial health and capabilities.

An ordinance when passed by the Council shall be signed by the Auditor. It shall be carefully filed and preserved in the custody of the Auditor (City Charter Chapter 2 Article 1 Section 2-122)
