Declare property located near the intersection of N Midway Ave and N Columbia Blvd as surplus property and authorize the Bureau of Transportation to dispose of the property for fair market value

Ordinance

The City of Portland ordains.

Section1. The Council finds:

  1. The City of Portland owns a 2,548-square-foot property, which consists of land quitclaimed from the Oregon State Highway Commission in 1948 (via a Quitclaim Deed, Book 1270, Page 76), and a portion of land vacated in 2018 under the adopted Ordinance 188038 and recorded as Document #2018-065681, further identified in Multnomah County Assessor’s records as R151411 (the “Property”). The Property was a remnant from the construction of N Columbia Blvd. A legal description and site map of the Property are attached as Exhibits A and B respectively, and by this reference incorporated herein.
     
  2. The Portland Bureau of Transportation (“PBOT”) maintains the vacant site, which has no transportation related use or benefit.
     
  3. Beginning in June 2024, PBOT solicited internal comments from within the bureau and declared it to be excess to its needs. PBOT worked with the City Real Property Coordinator in accordance with Administrative Rule 13.02 and notified other City bureaus of the intent to dispose of the Property. No City bureaus expressed interest or need to control or reserve easements on the Property. The City Real Property Coordinator and PBOT solicited external notification, which included posting signage, listing on City website, notifying neighborhood associations, mailing to surrounding properties, and notifying other government agencies. The Property is now presented to Council to be declared as surplus property for disposition.

NOW, THEREFORE, the Council directs:

  1. The Property is declared as surplus, and Council authorizes PBOT to dispose of the Property by sale on the open market.

Purpose of Proposed Legislation and Background Information

The City, through the Bureau of Transportation, desires to declare the 2,548 sq.ft. property, 
R151411, as surplus and dispose of the property for fair market value. The property 
consists of an area quitclaimed from the Oregon State Highway Commission in 1948 via a 
Quitclaim Deed, Book 1270, Page 76, and a portion of land vacated in 2018 under adopted 
Ordinance 188038 and recorded as Document #2018-065681. The property was a remnant 
from the construction of N Columbia Blvd.

Financial and Budgetary Impacts

The anticipated revenue is not in the FY 24-25 budget; however, the actual one-time revenue would be applied in the fiscal year in which revenue is received. 

This will be a net benefit as the property would be returned to tax rolls and ongoing maintenance and liability for PBOT would be eliminated.
