The City of Portland ordains:

Section 1. The Council finds:

1. The Design and Planning for the Red Electric Trail was identified by the Oregon Legislature in the Budget Report for House Bill 5006 (2021) as a recipient of Coronavirus State Fiscal Recovery Funding (CSFRF).
    
2. These resources are made available to Oregon projects under the federal American Rescue Plan Act (ARPA) approved by Congress to address the impacts of the coronavirus pandemic.
    
3. The $750,000 in grant funds will complete 30% design drawings for trail alignments on up to three Red Electric Regional Multi-Use Trail segments (the Alpenrose Dairy site segment, the segment east of Alpenrose Dairy between SW Shattuck Road and SW Cameron Road, and the properties near 3304 SW Bertha Blvd.). 
    
4. The trail is an important regional connector long planned for construction, and which will benefit local populations impacted by the Covid-19 pandemic, including public school children at Hayhurst Elementary, park users of Pendleton Park, preschoolers at the Southwest Parent-Child non-profit Co-op, the Marquis Vermont Hills post-hospital long term care facility, and gardeners at the Vermont Hills Community Garden. 
    
5. There were 21,041 jobs within 1/4 mile of the trail segments prior to March 2020, although some of those have most likely been lost due to the pandemic.
    
6. The SW Portland area lacks adequate sidewalks, and this high-quality active transportation infrastructure will improve walkability and safety for diverse users, regardless of age or ability.
    
7. The design drawings will be very helpful in allowing PP&R to advance construction of the designed trail segments in the future. 
    
8. The public will be consulted and advised of the project's process at several stages, including prior to the notice to proceed with design work. 
    
9. A 2007 Red Electric Trail Alignment Study will be used to guide the design process.  That 2007 study had a full public engagement process.

NOW, THEREFORE, the Council directs:

1. The Mayor is hereby authorized to accept on behalf of the City and appropriate a grant in the amount of $750,000 from the State of Oregon under the federal American Rescue Plan Act Coronavirus State Fiscal Recovery Fund for the purpose of Red Electric Trail Design and Planning and to execute a Grant Agreement substantially similar to Exhibit A.
    
2. FY 2021/2022 budget is hereby amended as follows:

3. The Office of Management & Finance Grants Management Division is authorized to perform all administrative matters in relation to the grant application, grant agreement or amendments, requests reimbursement from the grantor, and to submit required online grant documents on the Mayor’s behalf.
    
4. The Director of Portland Parks Bureau of the City of Portland is authorized to accept on behalf of the City of Portland any subsequent modifications by the State of Oregon for the Red Electric Grant, contract number 8107, provided such modifications do not increase the City of Portland’s financial obligation or risk.  Any modifications that increase the City of Portland’s financial obligation or risk must be authorized by the Portland City Council.

Section 2.  The Council declares that an emergency exists because a delay would unnecessarily hinder the City’s ability to accept and appropriate the grant funds; therefore, this Ordinance shall be in full force and effect from and after its passage by the Council.
