Amend Joint Office of Homeless Services Intergovernmental Agreement with Multnomah County to extend the term of the agreement (amend Contract 30005335)

The City of Portland ordains:

Section 1.  The Council finds:

  1. The County and PHB (“the Parties) entered into that certain Intergovernmental Agreement for the Joint Office of Homeless Services dated July 1, 2016 (the “Original Joint Office IGA”).
     
  2. The Original Joint Office IGA was amended by that certain First Amendment to Joint Office of Homeless Services dated April 18, 2017 (the “First Amendment”), and that certain Second Amendment to Joint Office of Homeless Services dated June 21, 2017 (the “Second Amendment”), and that certain Third Amendment to Joint Office of Homeless Services dated November 8, 2017 (the “Third Amendment”), and that certain Fourth Amendment to Joint Office of Homeless Services dated August 28, 2018 (the “Fourth Amendment”), and that certain Fifth Amendment to Joint Office of Homeless Services effective July 1, 2019 (the “Fifth Amendment”), and that certain Sixth Amendment to Joint Office of Homeless Services effective October 1, 2019 (the “Sixth Amendment”), and that certain Seventh Amendment to Joint Office of Homeless Services dated April 20, 2020 (the “Seventh Amendment”), and that certain Eighth Amendment to Joint Office of Homeless Services dated July 1, 2020 (the “Eighth Amendment”), and that certain Ninth Amendment to Joint Office of Homeless Services dated November 1, 2020 (the “Ninth Amendment”), and that certain Tenth Amendment to Joint Office of Homeless Services dated March 1, 2021 (the “Tenth Amendment”), and that certain Eleventh Amendment to Joint Office of Homeless Services dated August 18, 2021 (the “Eleventh Amendment”), and that certain Twelfth Amendment to Joint Office of Homeless Services dated December 15, 2021 (the “Twelfth Amendment”), and that certain Thirteenth Amendment to the Agreement dated May 12, 2022, and that certain Fourteenth Amendment to the Agreement dated October 3, 2022, and that certain Fifteenth Amendment to the Agreement dated July 1, 2022, and that certain Sixteenth Amendment dated May 16, 2023. The Original Joint Office IGA as amended by the First Amendment, Second Amendment, Third Amendment, Fourth Amendment, Fifth Amendment, Sixth Amendment, Seventh Amendment, Eighth Amendment, Ninth Amendment, Tenth Amendment, Eleventh Amendment, Twelfth Amendment, Thirteenth Amendment, Fourteenth Amendment, Fifteenth Amendment, and Sixteenth Amendment is referred to herein as the “Joint Office IGA”.
     
  3. Residents within both jurisdictions expect accountability and oversight regarding the investments in the Joint Office of Homeless Services (“Joint Office”). The changes set forth in this Seventeenth Amendment along with continued engagement in ongoing efforts to update and finalize new public-facing data dashboards, collectively determine budget allocations from various funding sources, and jointly determine impact measures will support accountability and oversight.
     
  4. The Parties require more time to conclude negotiations on a new intergovernmental agreement for the Joint Office and desire to amend the Joint Office IGA to extend the term of the agreement.

NOW, THEREFORE, the Council directs:

  1. The Commissioner in Charge of PHB is hereby authorized to execute the Seventeenth Amendment of the Joint Office IGA, substantially in accordance with “Exhibit A”.

An ordinance when passed by the Council shall be signed by the Auditor. It shall be carefully filed and preserved in the custody of the Auditor (City Charter Chapter 2 Article 1 Section 2-122)

Impact Statement

Purpose of Proposed Legislation and Background Information

This is the 17th Amendment to the Intergovernmental Agreement (IGA) governing the relationship between the City of Portland and Multnomah County related to the Joint Office of Homeless Services (JOHS).

  • This Amendment extends the IGA for one more fiscal year (FY 2023-2024).
    • This extension allows for full funding of the City of Portland portion of the JOHS budget in FY 2023-24.
  • The Amendment includes a clause directing the City of Portland to review the vitality and sustainability of the ongoing relationship with Multnomah County with respect to the JOHS in December of 2023, to determine if renewal or dissolution is the best option for FY 2024-2025.
  • This is the 17th Amendment to the JOHS IGA.

Financial and Budgetary Impacts

Execution of the seventeenth amendment will not result in any changes to the FY 2023-24 budget for the JOHS, nor does it result in any longer-term financial obligations or benefits.

The JOHS intends to receive, and subcontract amended funds for the provision of homeless services and permanent housing placement activities to people experiencing homelessness in the City of Portland.

Community Impacts and Community Involvement

This Council item authorizes an amendment to the existing IGA between the City of Portland and the Multnomah County Department Joint Office of Homeless Services. The authorization of an amendment to the IGA is a largely internal activity to city government processes and the transfer of funds from the City to the JOHS to subcontract for homeless services is consistent with the purpose of the IGA. Council’s action has low potential for controversy and a high level of support from the community.

Approval of the amendment does not impact the City’s total renewable energy use.

Budget Office Financial Impact Analysis

The intergovernmental agreement (IGA) extension does not include any changes to budgeted appropriations or make new ongoing commitments. This amendment also includes a clause to review and evaluate the IGA.
