12.15.200 Application to Existing Agreements.

  1. A. To the extent that this Chapter is not in conflict with and can be implemented consistent with existing agreements, this Chapter will apply to all existing agreements granted to utility operators by the City. To the extent that a term of such an existing agreement irreconcilably conflicts with a provision of this Chapter, the term of the existing agreement will control for the remainder of the agreement’s term.
  2. B. A licensee who had a franchise agreement with the City prior to obtaining a license under this Title and paid on a linear foot basis will continue to pay fees on that basis. The number of linear feet upon which the fee is calculated will remain in effect until the licensee constructs or acquires facilities in new locations in the right-of-way, sells any facilities within the right-of-way existing at the time of the transition from a franchise to a license under this Chapter, or no longer uses the applicable facilities.
