12.15.040 Jurisdiction and Management of the Public Right-of-Way.

  1. A.  The City has jurisdiction and exercises regulatory management over and controls access to all right-of-way within the City under authority of the City Charter and state law.
  2. B.  The City has jurisdiction and exercises regulatory management over each right-of-way whether the City has a fee, easement, or other legal interest in the right-of-way, and whether the legal interest in the right-of-way was obtained by grant, dedication, prescription, reservation, condemnation, annexation, foreclosure, or other means.
  3. C.  The exercise of jurisdiction and regulatory management of a right-of-way by the City is not official acceptance of the right-of-way and does not obligate the City to maintain or repair any part of the right-of-way.
  4. D.  The provisions of this Chapter are subject to and will be applied consistent with applicable state and federal laws, rules, and regulations and, to the extent possible, will be interpreted to be consistent with such laws, rules, and regulations.
