Adoption of an interim administrative rule for Title 16 – Renewable Fuel Standard due to COVID-19

The measures taken to reduce the spread of COVID-19, including Governor Brown’s stay at home order, have caused a dramatic decrease in gasoline demand. Decreased demand is inhibiting regulated parties upstream of fuel retailers from making room in their tanks for summer gasoline by May 1, 2020, after which the sale of winter gasoline is prohibited.

Due to these extenuating circumstances, and the potential resulting increased volatility of gasoline supply and prices, an interim rule is set forth that waives the local requirement to sell summer gasoline after May 1, 2020. This interim rule aligns with similar emergency response steps taken by the State of Oregon to address this issue. 

Interim rules associated with this code must remain in effect for 365 days or until subsequent administrative rules are issued. The City of Portland will continue coordinating closely with the State to monitor the situation and will adjust this interim rule if necessary.
