After Council adoption, the River Plan was appealed by Gunderson, LLC; Schnitzer Steel Industries; and the Working Waterfront Coalition. On Jan. 21, 2011, the state Land Use Board of Appeals (LUBA) remanded the plan back to the City, nullifying the July 1, 2011, effective date. In response to the LUBA ruling, the Bureau of Planning and Sustainability is conducting more detailed analyses to clarify the potential impact of the plan on industrial land supply.
The petitioners in the LUBA appeal have given notice that they will be appealing LUBA’s decision to the Court of Appeals. The contents of the appeal will not be available until March 4, after which the City will have three weeks to reply with arguments.
