Public comment period open for Commercial Building Energy Performance administrative rules

The public comment period on proposed administrative rules for the updated Commercial Building Energy Reporting (PCC 17.104 Commercial Building Energy Performance) is open through 11:59 p.m. on Sunday, December 14, 2025.

The public is invited to submit comment on the proposed administrative rules for the updated Commercial Building Energy Performance Reporting. This public comment period seeks input on proposed changes BPS has made to the administrative rules. This rulemaking process will result in permanent rules effective upon adoption.

The most significant changes include:

  • Excluded parking floor area when determining whether a building is covered;
  • Updated energy consumption data fuel types consumed to include all fuel types;
  • Updated reporting on-site energy generation to net consumption to align with ODOE's building performance standard policy; and
  • Updated the process to establish a primary contact to coordinate compliance.

Additional changes were made to clarify the extension period deadline of June 22 of the reporting year and error corrections resolved by July 15 of the reporting year. In addition, there are numerous non-substantive formatting, text, and punctuation changes for consistency with other City policy documents.
