Statement on issuance of building permit for non-fossil fuel infrastructure at Zenith Energy

This building permit allows Zenith Energy to begin construction of infrastructure for non-fossil fuel uses. These uses are compatible with the City’s Comprehensive Plan and zoning code, and the construction plans meet state and local building codes.

The Bureau of Development Services announced last August, when it denied the Land Use Compatibility Statement for the renewal of Zenith’s air quality permit with DEQ, that this separate building permit for non-fossil fuel infrastructure was expected to be issued in September 2021. The permit was issued on April 15 after Zenith Energy paid all its required fees.

This building permit was the focus of a separate Land Use Compatibility Statement, issued in April 2021 for a DEQ stormwater permit, that sets legally binding requirements on the uses of this new rail infrastructure for non-fossil fuel uses.
