Amendments to Title 11, Trees, Regarding Trees in Development Situations,
Become Effective March 16, 2018

These changes were approved by the Portland City Council on Feb. 14, 2018 and will go into effect on March 16, 2018. 

The amendments to Title 11 and results for customers are summarized as follows: 

  • Trees are subject to the preservation requirements of PCC 11.50, Trees in Development Situations, ONLY IF ground disturbance impacts the Root Protection Zone of at least one regulated tree. Removal of trees through a development permit is no longer allowed if no regulated tree faces an impact by the development.
     
  • Clarifies that if not subject to 11.50, Trees in Development Situations, removal of regulated trees must be approved through Urban Forestry Tree Permit subject to 11.40, Tree Permit Requirements. 
     
  • Existing trees must still be shown on the site plan for all development permits to document tree sizes, species and resulting root protections zones, UNLESS there are no Private Trees 12 inches or greater, no City Trees six inches or greater, no Street Trees three inches or greater, and the Tree Density requirements do not apply. 
     
  • The appeal process for 11.50, Trees in Development Situations is codified and allows for an Administrative Review by City Forester or BDS Director, as appropriate, with appeal to Code Hearings Officer.
