The City Auditor has adopted new rules and amended rules relating to campaign finance and political consultant registration and reporting.

The City Auditor has adopted the following new administrative rules:

ARA 13.05 – CAMPAIGN FINANCE: CONTRIBUTION LIMITS
ARA APPENDIX A
ARA 14.01 – POLITICAL CONSULTANT REGISTRATION AND REPORTING

The City Auditor adopts ARA 13.05 to provide additional guidance on receipt and sources of contributions, limits and exceptions on contributions, and applicability of limits to public funding program participants.

The City Auditor adopts ARA APPENDIX A to include contribution and spending limits updated for inflation.

The City Auditor rescinds and replaces ADM-15.20 and ADM-15.21 with new ARA 14.01 to define essential terms such as covered client, person, and political consultant; clarify processes surrounding investigations, determinations, reconsiderations, and appeals; and clarify penalties for political consultant registration and reporting regulations.

The City Auditor has also amended the following administrative rules:

ARA 13.02 – CAMPAIGN FINANCE: DEFINITIONS
ARA 13.03 – CAMPAIGN FINANCE: COMPLAINT PROCESS
ARA 13.04 – CAMPAIGN FINANCE: DISCLOSURE REQUIREMENTS

The City Auditor amended ARA 13.02 to provide clarity for defined terms such as written communication, election cycle, and complaint.

The City Auditor amended ARA 13.03 to provide additional guidance on information required for complaints; explain processes for subpoena enforcement, withdrawal, and reconsideration; add information required for violation letters; expand penalty considerations; clarify late fees; and amend the willful violation standard to a knowing violation.

The City Auditor amended ARA 13.04 to provide guidance on which communications are subject to disclosures, required content for disclosures, and inclusion of disclosures on social media.

The rules were adopted following a public comment period of 30 days. The effective date of the adopted rules is June 1, 2021.
